         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests his DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to add his secret security clearance, his last reenlistment dated 7 November 1986, and his primary military occupational specialty of armor crewman.

3. The applicant states he wants his DD Form 214 to properly reflect his military career.

4. The applicant’s military records show that he enlisted in the Regular Army on 10 November 1976. He was awarded the military occupational specialty of armor crewman, 11E, on 24 February 1977, which was reclassified to 19E on 1 March 1978. He was promoted to pay grade E-5 and immediately reenlisted for 6 years on 16 July 1980. He was awarded the MOS of administrative specialist, 71L, on 23 April 1981, and the MOS of personnel administration specialist , 75B, on 9 November 1981. He immediately reenlisted for 6 years on 7 November 1986 and was promoted to pay grade E-6 on 4 June 1987. He had been awarded a secret security clearance on 31 May 1977, which was updated on 18 August 1983.

5. On 18 December 1988 he was honorably released from active duty and placed on the retired list the following day due to permanent physical disability. The DD Form 214 he was issued shows his MOS’s as 75B, personnel administration specialist, and 71L, administrative specialist. His DD Form 214 also shows that he immediately reenlisted from 10 November 1976 to 15 July 1980, and from 16 July 1980 to 6 November 1986. His DD Form 214 does not show that he was awarded a security clearance.

6. Army Regulation 635-5, provides the guidance for completing DD Forms 214. It states “Enter the MOS codes, titles, years and months for warrant officers and enlisted personnel.” It also states “Enter a list of enlistment periods for which a DD Form 214 was not issued . . . Example: Immediate reenlistments this period: 761210-791001; 791002-821001.” This regulation does not contain any provisions to record a soldier’s security clearance.

CONCLUSIONS:

1. The applicant’s MOS 19E, armor crewman, should have been listed on his DD Form 214. His former MOS, 11E, which was reclassified, no longer existed at the time of his separation and, therefore, should not be listed.

2. His last reenlistment, however, was properly not listed in accordance with Army Regulation 635-5 since he was issued a DD Form 214 for that reenlistment.

3. There are no provisions to enter a soldier’s security clearance on his DD Form 214.
4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by issuing to the individual concerned a DD Form 215 which adds MOS 19E.

2. That so much of the application as is in excess of the foregoing be denied.
