         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that the amount of disability severance pay that is listed on his DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected.

3. The applicant states that he had received $44,258.40 in disability severance pay, not $51,634.80, the amount which is listed on his DD Form 214.

4. In support of his application he submits his final Leave and Earnings Statement (LES) which shows that he received $44,258.40 in disability severance pay.

5. The applicant’s military record shows that he enlisted in the Regular Army on 17 June 1985, was awarded the military occupational specialty of ammunition specialist, and was promoted to pay grade E-5. He was honorably released from active duty on 7 September 1999 by reason of physical disability, rated 20 percent disabled. The DD Form 214 he was issued shows that he was given $51,634.80 in disability severance pay.

CONCLUSIONS:

1. The applicant’s LES confirms that an error was made on the amount of severance pay shown on his DD Form 214.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by issuing to the individual concerned a DD Form 215 showing that he received















$44,258.40 in disability severance pay when he was released from active duty on 7 September 1999.
