         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to show the award of five Bronze Star Medals (BSM with 4 oak leaf clusters).

3. The applicant states that he was awarded an additional BSM based on his award of the Combat Infantryman Badge (CIB).

4. The applicant’s military records were lost or destroyed in the 1973 fire at the National Personnel Records Center. Available records from alternate sources show that he served on active duty in an enlisted status beginning on an unknown date and arrived in Ireland on 19 October 1943. He served in the European Theater and was commissioned a second lieutenant of Infantry on 11 September 1944. He was separated from active duty on 17 October 1945 as a first lieutenant. His WD AGO Form 53-98 (Report of Separation) shows that his authorized awards included the BSM with 3 oak leaf clusters (four awards).

5. On 25 October 1991 the applicant was issued a DA Form 1577 (Authorization for Issuance of Awards) which showed that he was authorized a fourth oak leaf cluster to the BSM based on the award of the CIB.

CONCLUSIONS:

1. The applicant’s available records clearly show that he is entitled to correction of his records to show award of the BSM with 4 oak leaf clusters (five awards).

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case for the individual concerned be corrected by showing that he was awarded the Bronze Star Medal with 4 oak leaf clusters.
