         I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual.

         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests reconsideration of his previous appeal to amend his records by showing he is eligible for the Army of Occupation Medal.

3. He states that his unit did serve in the geographic areas of Italy that qualified for the award. He provides copies of various appointment and assignment orders and annotated maps to substantiate his case.

4. The Memorandum of Consideration (MOC) of the Board’s 29 April 1999 review of his request (AR1999020711) is incorporated herein by reference as if wholly set forth.

5. As noted in the original MOC the Army of Occupation Medal was awarded for service in Italy between 9 May 1945 and 15 September 1947. Unless the unit is listed in Department of the Army, General Orders Number 4 of 1947 the service must have been performed in the Compartment of Venezia Giulia E. Zara or the Providence of Udine.

4. An examination of the unit records shows that the applicant’s unit served in Udine during July 1945 and in Venezia Giulia E. Zara during August 1945.

5. The above findings constitute a manifest error that requires Board consideration.

CONCLUSIONS
:

1. The applicant’s service met qualifying conditions and he is entitled to the Army of Occupation Medal.

2. In view of the foregoing findings and conclusions, correcting the applicant’s records as recommended below would correct an error.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned is entitled to the Army of Occupation Medal.
