         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that item 12 (Record of Service), b (Separation Date This Period) and, in effect, c. (Net Active Service This Period) of her DD Form 214 (Certificate of Release or Discharge from Active Duty), dated 17 January 1992 (sic) be corrected to read 15 December 1990 and 90 days, respectively.

3. The applicant states that her orders were for 90 days of active duty, while her DD Form 214 indicates she served for 1 year, 4 months and 1 day. She provides copies of the pertinent orders and DD Form 214.

4. The applicant’s military records show that she was ordered to active duty at Dewitt Army Hospital, Fort Belvoir, Virginia in support of Desert Storm by Total Army Personnel Command, St. Louis, Missouri, orders dated 12 September 1990 for a period of 90 days, effective 17 September 1990 (Item 12a, DD Form 214, Date Entered AD This Period).

5. On 14 January 1991, a DA Form 67-8 (Officer Evaluation Report) was rendered by Army officials at Dewitt Army Hospital for the period 17 September to 15 December 1990, a period of 90 days (3 months).

6. Army Regulation 635-5 (Personnel Separations – Separation Documents) indicates, in pertinent part, that item 12b, DA Form 214 is the individual’s transition date and item 12c is the amount of service this period, computed by subtracting item 12a from 12b.

CONCLUSIONS:

1. The evidence of record clearly shows the applicant entered active duty on 17 September and was released on 15 December 1990 for 90 days of active duty, and her DD Form 214 should be corrected accordingly.

2. This is clearly supported by her orders and her Officer Evaluation Report submitted for her period of active duty.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by changing item 12b, DD Form 214, dated 17 January 1992 to read “90-12-15” and item 12c to read “00-03-00” and by forwarding a corrected DD Form 214 to the applicant.
