         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, that his DD Form 214, Report of Transfer or Discharge, be corrected to show all of the awards to which he is entitled, the length of time spent in Germany and his education and training.

3. The applicant states in a letter subsequent to his application that his DD Form 214 does not specifically reflect that he was awarded the Purple Heart for wounds received in combat.

4. The applicant’s military records show that he was inducted on 31 July 1967 and served as an infantry indirect fire crewman with the 1st Cavalry Division in Vietnam from 30 March 1968 to 7 June 1968. He was honorably separated on 2 August 1969 in the grade of sergeant.

5. His awards include the National Defense Service Medal, Vietnam Service Medal with 1 Bronze Service Star, Vietnam Campaign Medal with 1960 Device, Air Medal and the Combat Infantryman Badge. Additionally, his record contains orders showing that he was awarded the Purple Heart on 20 May 1968 and the Marksman Badge with Rifle Bar, but neither of these awards is listed on the DD Form 214.

6. Item 22c (foreign and/or sea service) of his DD Form 214 is annotated Vietnam & Germany and shows that he completed a total of 4 months and 13 days in these countries.

7. Item 25 (education and training completed) shows that he completed ATP 21-114 (basic and individual training), Code of Conduct, Military Justice Course B, Geneva Convention and CBR Training.

8. Army Regulation 635-5, Separation Documents, prescribes the separation documents that are prepared for individuals upon retirement, discharge or release from active military service or control of the Army. It establishes standardized policy for preparing and distributing DD Form 214 and prescribes procedures for completing each of the items thereon.

CONCLUSIONS:

1. Careful review of the applicant’s Official Military Personnel File (OMPF) shows that the Purple Heart and the Marksman Badge with Rifle Bar were inadvertently left off his DD Form 214 at the time it was prepared. His record does not show, however, that he is entitled to any other awards.

2. Insofar as recording his overseas service (item 22c of the DD Form 214) is concerned, the combined service in each of the countries listed is appropriately listed as a total service for both and not individually for each country in which he served. Further, the amount of service listed is confirmed by entries in his OMPF, thus, no correction to this item is necessary.

3. Similarly, the education and training completed (item 25) is consistent with instructions for completing this block so no correction is necessary for this item either.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by:

         a. showing that the individual concerned was awarded the Purple Heart and the Marksman Badge with Rifle Bar; and

         b. issuing a correction to his DD Form 214 reflecting the above mentioned awards.

2. That so much of the application as is in excess of the foregoing be denied.
