APPLICANT REQUESTS: That he receive medical specialty pay for being trauma/critical care qualified.

APPLICANT STATES : That he received the bonus for 1997 but should have received it for 1995 and 1996.

EVIDENCE OF RECORD : The applicant’s military records are not available.

The applicant earned his doctor of medicine degree on 28 May 1989. He served as the Assistant Unit Chief, Division of Trauma and Critical Care from 1 July 1994 to 30 June 1995. On 6 June 1995, he received his surgeon certification. Apparently, he came on active duty some time in 1995 and is presently serving at William Beaumont Army Medical Center (WBAMC), El Paso, TX.

In the processing of this case, three advisory opinions were obtained.

The first opinion, from the AMEDD Special Pay Branch, notes that the applicant’s Career Management Individual File and the Total Officer Personnel Management Information System do not indicate he was ever trained, assigned or utilized as a trauma/critical care surgeon; that the only supporting documentation he provided to indicate the subspecialty competency was a certificate that he served as Assistant Unit Chief, Division of Trauma and Critical Care; and that he failed to supply Incentive Specialty Pay contracts for 1995 and 1996 from his command authorizing him the pay.

The second opinion, also from the AMEDD Special Pay Branch, noted that the Chief, Department of Surgery, WBAMC, stated that the applicant did a one year fellowship in a program that was not accredited during his attendance and that the Army did not recognize him as trained in trauma/critical care for the official record. Also, while he was privileged in trauma/critical care, the applicant was still only recognized as a general surgeon.

The third opinion is from the Chief, Medical Corps Branch, who states that the applicant has not submitted documentation that he completed an accredited trauma fellowship program in accordance with special pay messages released by the Surgeon General’s Office.

DISCUSSION : Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record and advisory opinions, it is concluded:

1. The applicant has not shown that he has completed the required training to earn incentive specialty pay for the trauma/critical care subspecialty.

2. In view of the foregoing, there appears to be no basis for granting the applicant’s request.

DETERMINATION : The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
