         I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. The following members, a quorum, were present:

         The applicant and counsel if any, did not appear before the Board.

         The applicant requests correction of military records as stated in the application to the Board and as restated herein.

         The Board considered the following evidence:

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his report of separation (DD Form 214) dated 8 July 1993 be corrected to show that he received $7,117.92 in separation pay.

3. The applicant states that he received $7,117.92 in separation pay; however, his DD Form 214 shows that he received $10,017.92. In support of his application he submits copies of the final pay vouchers he received pursuant to his separation.

4. The applicant’s military records show that the applicant was honorably discharged in the pay grade of E-5 on 8 July 1993 under the provisions of Army Regulation 635-200, chapter 4. He had served 12 years, 10 months, and 17 days of total active service and was authorized one-half separation pay. His DD Form 214 indicates that he was paid $10,017.92 in separation pay.

5. The supporting documents submitted by the applicant shows that the applicant was authorized to receive $7,117.92 in separation pay and after taxes were deducted, he received $6,351.73.

CONCLUSIONS:

1. The applicant was properly separated from the service and paid one-half separation. However, it appears that an administrative error resulted in an incorrect amount being entered on his DD Form 214.

2. Therefore, it would be appropriate at this time to correct his records to show that the applicant received $7,117.92 in separation vice the $10,017.92 currently reflected in his records.

3. In view of the foregoing, it would be appropriate to correct his records as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned received $7,117.92 in separation pay vice the $10,017.92 currently reflected in his records.
