APPLICANT REQUESTS: Award of the Armed Forces Expeditionary Medal.

APPLICANT STATES : He was not eligible to be awarded this medal when he retired in August, 1995, but requests award of it at the present time because he asserts that the requirements for the medal recently have changed, and he now is qualified to receive it.

EVIDENCE OF RECORD : The applicant's military records show:

He served continuously on active duty from September 1974 until August, 1995, when he retired as a Staff Sergeant. From August 19, 1990 until March 28, 1991 he served in Saudi Arabia as a Battalion NBC NCO at Dhahran Air Force Base. This was his only service in the Persian Gulf Area, and for it he was awarded the Southwest Asia Service Medal (SWASM) with bronze service stars for the Defense of Saudi Arabia (2 August 1990 to 16 January 1991), and the Liberation and Defense of Kuwait (17 January to 11 April 1991).

He returned to the United States in March, 1991, and served at Ft. Leonard Wood, Missouri, until his retirement in August, 1995.

The Armed Forces Expeditionary Medal (AFEM) was authorized for service in the Persian Gulf Area as part of Operation Earnest Will (24 July 1987-1 August 1990) and Operation Southern Watch (1 December 1995 to a date to be determined). The applicant’s service in Saudi Arabia, therefore, did not coincide with either of the two periods of time for which the Armed Forces Expeditionary Medal is authorized.

DISCUSSION : Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:

1. While the applicant is correct that the prerequisites for award of the AFEM recently have been changed, the change does not affect him because he did not serve in the Persian Gulf Area during either of the two periods of service which qualify for award of the medal.

2. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.

3. In view of the foregoing, there is no basis for granting the applicant’s request.

DETERMINATION : The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
