2. In effect, the applicant requests that her military records be corrected to show that she was enlisted in the Army Reserve on 12 March 1996 in pay grade E-2 or higher.
3. The applicant states she enlisted in the Regular Army from the delayed entry program on 22 April 1996, and during her initial processing for enlistment in the Army Reserve, she provided a diploma and certificate showing that she had 72 college credits, believing her enlisted grade would be
E-2 or E-3. She was told, in effect, that she would be advanced in grade at her first duty station.
4. The applicant enlisted in the Army Reserve on
12 March 1996 in the delayed entry program (DEP) in pay grade E-1. She was discharged from that program and enlisted in the Regular Army for three years on
22 April 1996 in pay grade E-1.
5. On 6 August 1993 the applicant was issued a diploma from the Instituto de Banca y Comercio, in Mayaguez, Puerto Rico, for satisfactorily completing the Emergency Medical Technology Paramedic Course (1,293 hours).
7. At the request of this Board, the applicant has provided a transcript showing that she received 72 credits from the aforementioned institution, beginning that course on
9 September 1991 and completing it on 6 August 1993.
8. Informal coordination with an official in the Registrars office at the Instituto de Banca indicated that the course the applicant completed was one academic year of study (NOTE: The applicant completed this one academic year over a two year period).
9. In the processing of this application, an advisory opinion was obtained from the Retention Management Division of the Total Army Personnel Command (PERSCOM) (COPY ATTACHED). An official of that agency stated that the number of clock hours the applicant completed does not convert to the required semester hours required for enlistment in pay grade E-2, and recommended that her request be denied.
10. Army Regulation 601-210 prescribes the eligibility criteria for enlistment in the Army. Paragraph 2-20e of that regulation states, in effect, that an applicant who has successfully completed 30 or more semester hours of an accredited college or university listed in the Accredited Institutions of Postsecondary Education Book will be enlisted in pay grade E-2.
11. Paragraph 2-22 of that regulation provides a formula for equating clock hours to semester hours, stating that 45 clock hours equate to one semester hour.
12. Paragraph 2-20h of that regulation states, in effect, that an applicant who has successfully completed two or more academic years of a postsecondary vocational-technical school and has received a certificate of training attesting to successful completion of the course will be enlisted in pay grade E-3.
CONCLUSIONS:
1. The applicant did not have the required clock hours or the number of academic years of study to be enlisted in pay grade E-2 or E-3, and she was properly enlisted in pay grade E-1, in accordance with Army regulations.
2. Notwithstanding the above information, the applicants statements are believable. Her effort in responding to a request from this Board to provide a copy of her transcript only adds to the creditability of her story.
3. In all fairness to the applicant and as an exception to policy, her records should be corrected to show that she enlisted in the Army Reserve on 12 March 1996 in pay
grade E-2.
4. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicants records as recommended below.
RECOMMENDATION:
That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was enlisted in the Army Reserve on 12 March 1996 in pay grade E-2, as an exception to policy.
