2.  The applicant requests that his DD Form 214 for the period covering 21 March 1961 to 14 March 1967 be corrected to show he entered on active duty on 30 May 1958.

3.  The applicant’s records show that he enlisted on 31 May 1955 and was honorably discharged at the expiration of his term of service on 29 May 1958.  He was issued a DD Form 214 for that service.

4.  He had a break in service of a couple of days and reenlisted on 4 June 1958.  He served continuously through a reenlistment on 21 March 1961 and was honorably discharged on 14 March 1967 as an overseas returnee with insufficient time remaining on his term of service to warrant assigning him to a unit.

5.  Army Regulation 635-5 provides the guidance for the issuance and completion of DD Forms 214.  Paragraph 1-4b of this regulation states that a DD Form 214 will not be issued to enlisted members who immediately reenlist in the Regular Army.

CONCLUSIONS:

1.  The applicant had a break in service after his discharge on 28 May 1958 until his enlistment on 4 June 1958.  As such, his request to have his DD Form 214 reflect service beginning on 30 May 1958 is not appropriate.

2.  However, the applicant’s active service from 4 June 1958 to 20 March 1961, the day prior to his reenlistment, is not reflected on any separation document contained in his records.  The DD Form 214 he was issued for the period ending on 14 March 1967 should have had his date of entry listed as 4 June 1958, not 21 March 1961.

3.  In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1.  That all of the Department of the Army records related to this case be corrected by issuing to the individual concerned a DD Form 215, Correction of DD Form 214, for the period ending 14 March 1967, which corrects item 17c, Date of Entry, from 21 March 1961 to 4 June 1958.

2.  That so much of the application as is in excess of the foregoing be denied.
