2. The applicant requests correction of his military records to show that he was awarded the Purple Heart, the Bronze Star Medal (BSM), the Vietnam Cross of Gallantry and the Army Commendation Medal (ARCOM). In support of his request he provides a copy of a Western Union telegram from the Department of the Army to his parents advising them that he had been wounded in Vietnam on 28 June 1969, a copy of the Vietnam Cross of Gallantry citation naming him as the recipient, and a copy of the orders, certificate and citation awarding him the ARCOM.
3. He states that he was recommended for the above awards but they do not appear on his DD Form 214, Report of Transfer or Discharge.
4. His military records show that he enlisted in the Regular Army for 3 years on 27 May 1968 and after spending 1 year, 6 months and 10 days in Vietnam he was honorably discharged on 26 May 1971.
5. The military awards reflected on his DD Form 214 include the National Defense Service Medal, the Vietnam Service Medal and the Vietnam Campaign Medal.
6. His military records also contain copies of the documents included with his application awarding him the Purple Heart, the Vietnam Cross of Gallantry and the ARCOM. There is, however, no documentation in the record to show that he was recommended for or awarded the BSM.
7. Army Regulation 600-22-8, Military Awards, provides, in pertinent part, that the Bronze Star Medal is awarded to any person who, while serving in any capacity in or with the Army of the United States after 6 December 1941, distinguished himself by heroic or meritorious achievement or service, not involving participation in aerial flight, in connection with military operations against an armed enemy; or while engaged in military operations involving conflict with an opposing armed force in which the United States is not a belligerent party.
CONCLUSIONS:
1. The evidence of record shows that he was awarded the Vietnam Cross of Gallantry, the ARCOM and should have been awarded the Purple Heart.
2. There is no evidence to show that he was awarded the BSM.
3. In view of the foregoing, the applicants records should be corrected as recommended below.
RECOMMENDATION:
1. That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the Purple Heart, the Vietnam Cross of Gallantry and the ARCOM.
2. That so much of the application as is in excess of the foregoing be denied.
