2.  The applicant requests removal from her Official Military Personnel File (OMPF) of a memorandum dated 1 February 1991 issued by the Total Army Personnel Command (PERSCOM), notifying her of her nonselection for promotion to captain. 

3.  The applicant states, in effect, that the memorandum was issued prematurely, in that she was not eligible for consideration for promotion at the time.  Consequently, this Board corrected her record and she was properly considered and selected for promotion at the appropriate time.  However, the erroneous memorandum continues to remain in her OMPF.

4.  The applicant’s military records show that the applicant previously applied to this Board because she had been prematurely considered and nonselected for promotion to captain.  This Board determined that her records should be reviewed by a USAR Standby Advisory Board under the original criteria followed by the first promotion board under which she was eligible for consideration.  Thereafter, she was selected for promotion to the rank of captain.

5.  The PERSCOM, St. Louis, Missouri, in a memorandum to this Board, recommended that the applicant’s request be approved.

CONCLUSIONS:

1.  As a result of a previous action by this Board, the applicant was selected for promotion in what amounted to her first consideration.  Consequently, the original memorandum of nonselection for promotion dated 1 February 1991 should have been removed from her OMPF.

2.  Inasmuch as the memorandum of nonselection was not removed from her OMPF, it would be appropriate to do so at this time.

3.  In view of the foregoing, it would be appropriate to correct the applicant’s records as recommended below. 


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by removing from the OMPF of the individual concerned the 1 February 1991 memorandum indicating her nonselection for promotion.
