APPLICANT REQUESTS: That his DD Form 214, Report of Transfer or Discharge, be corrected to show that he was awarded the Army Good Conduct Medal (AGCM) and the Expert Badge with rifle bar.
APPLICANT STATES: That since the DD Form 214 is a historical document he wants it to correctly reflect the facts of his service.
EVIDENCE OF RECORD: The applicant's military records show:
He was inducted on 5 October 1965 and served 11 months and 4 days in Vietnam. He was honorably separated and transferred to the USAR on 25 September 1967 to complete his military service obligation.
His enlisted qualification record and his DD Form 214 show that he was awarded a Marksman Badge with rifle bar (for the M-14 rifle) based on US Army Training Center, Armor, Fort Knox, Kentucky, special order 333, dated 29 November 1965. There are no documents elsewhere in the file to indicate that he fired expert with the rifle.
The applicants record reflects that the Commander, US Army Reserve Personnel Center (ARPERCEN) corrected his record on 22 April 1996 to reflect that he was awarded the AGCM. DD Form 215, Correction of DD Form 214, was issued to him on that date showing the correction made.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. The applicants request for the AGCM was administratively granted by the ARPERCEN.
2. There is no evidence in the record and the applicant has provided no evidence to indicate that he ever fired or was awarded the Expert Badge for the rifle.
3. In view of the foregoing, there appears to be no basis for granting the applicants request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
