APPLICANT REQUESTS:  That his DD Form 214, Report of Transfer or Discharge, be corrected to reflect the following awards:  the National Defense Service Medal (NDSM), the Vietnam Service Medal (VSM), the Vietnam Campaign Ribbon (VCR), the Bronze Star Medal (BSM) with 1st oak leaf cluster and “V” device, the Air Medal (AM), the Army Commendation Medal (ARCOM) with 1st oak leaf cluster and a correction to show that he served in Vietnam for 18 months.

APPLICANT STATES:  In effect, that his DD Form 214 does not accurately reflect his awards and the length of his tour of duty in Vietnam.

EVIDENCE OF RECORD:  The applicant's military records show:

He enlisted in the Regular Army for 3 years on 22 January 1968 and served 1 year, 6 months and 1 day in Vietnam.  He was honorably discharged on 22 January 1971 in pay grade   E-5.

The DD Form 214 prepared on 22 January 1971 shows that he was authorized the NDSM, the VSM and the VCM.  (The US Army Reserve Personnel Center (ARPERCEN), after reviewing his records, determined that he was also authorized the BSM with “V” device, but not an oak leaf cluster, the AM, and the ARCOM with 1st oak leaf cluster.  It determined, in fact, that he was entitled to all of the awards he requested with the exception of the 1st oak leaf cluster to the BSM.)  He was advised of the correction to his records on 4 April 1996 via DD Form 215, Correction of DD Form 214.

His DD Form 214 shows under foreign and/or sea service that he served 1 year, 6 months and 1 day with the US Army Pacific (Vietnam).  In the remarks section of the form (Block 30), it indicates that his inclusive dates of Vietnam service were from 8 June 1968 to 8 January 1969, an obvious typographical error since that period would represents only a 7 month tour of duty.

DISCUSSION:  Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:

1.  The ARPERCEN has administratively corrected his DD Form 214 to show his entitlement to all of the awards he requested, except the 1st oak leaf to the BSM.  His military records, however, contain no documentary evidence to support that he was ever recommended for or awarded a 1st oak leaf cluster to the BSM.

2.  In view of the foregoing, there appears to be no basis for granting the applicant’s request.

DETERMINATION:  The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.

NOTE:  The Commander, ARPERCEN will be requested to correct the entry in the remarks section (Block 30) of DD Form 214 pertaining to the applicant’s inclusive dates of service in Vietnam.  The correct dates should be 8 June 1968 to 8 December 1969 to be consistent with the 1 year, 6 months and 1 day of foreign and/or sea service reflected in block 22c of the form.
