2. The applicant requests that the 355 days he served on active duty while in the Regular Army be considered qualifying for retired pay.

3. The applicant states that he arrived back in the United States from Germany and was released from active duty 10 days prior to the expiration of his term of service (ETS). His early release from active duty was not of his choosing and is now being counted against him in the loss of that year as qualifying service.

4. The applicant's military records show that he enlisted for 3 years in the Regular Army on 7 July 1958 in pay grade E-1, was promoted to pay grade E-2, and was awarded the military occupational specialty of structural specialist. He was honorably released from active duty on 26 June 1961 by reason of early release of overseas returnee, a convenience of the Government separation. He had 2 years, 11 months and 20 days of active service.

5. He then had a break in service until his enlistment in a USAR unit on 13 August 1977 in pay grade E-4. He has served continuously, performing duties as a senior tank commander, and has been promoted to pay grade E-7.

6. Army Regulation 635-205, paragraph 7, in effect at the time, required the separation of soldiers who were returned from overseas duty who had less than 60 days remaining on their enlistments.

CONCLUSIONS:

1. The applicant was required to be separated prior to his ETS due to his early return from overseas duty. He had no choice in the matter.

2. It would be inherently unjust not to count 355 days of continuous active duty as qualifying for retired pay when the soldier had no choice in the separation and it was for and at the convenience of the Government.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the applicant’s retirement year ending 6 July 1961 is qualifying for retired pay.

BOARD VOTE:

                       GRANT AS STATED IN RECOMMENDATION

                       GRANT FORMAL HEARING

                       DENY APPLICATION

The applicant requests correction of military records as stated in the application to the Board and as restated herein. On 2 April 2001, the Army Reserve Command in St. Louis informed a Member of Congress that the applicant’s records were corrected to credit him with 355 retirement points for the retirement year ending in 1961 because that was the number of days that he spent on active duty. Paragraph 1-4 of that regulation provides the criteria for establishing or changing the retirement...

He was not told at the time of his separation that his early release would result in that year not being considered qualifying for retired pay. To penalize the applicant for the Government’s action by denying him his last year of active service as qualifying for retired pay is unfair. RECOMMENDATION: That all of the Department of the Army records related to this case be corrected by showing that the retirement year 30 June 1972 through 29 June 1973 is qualifying for retired pay for the...

The applicant requests correction of his records to show he completed 15 years and 29 days of total active service. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. The applicant was not offered early retirement under TERA because he was involuntarily separated due to reaching the RCP for a Soldier in the pay grade of E-5.

The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period ending 22 July 1964 to show he completed 3 years of active service instead of 2 years, 11 months, and 2 days. The applicant states the requested credit of an additional 29 days of active service would allow him to retire from the U.S. Army Reserve (USAR). His USAR Personnel Command (ARPC) Form 249-E (Chronological Statement of Retirement Points) shows he...

The applicant requests, in effect, that item 12b (Separation Date This Period), of his DD Form 214 (Certificate of Release or Discharge from Active Duty) be corrected. Therefore, there is insufficient evidence to correct item 12b, of his DD Form 214, to show that he completed 24 months of active duty service. It is evident that the applicant requested early release from active duty to join a TPU 10 days prior to his original scheduled ETS of 28 February 1986.

The applicant provided a copy of his DD Form 4, dated 19 January 1954, which shows that he enlisted for a period of 3 years on 19 January 1954. The evidence of record shows that he enlisted for a period of 3 years and served his commitment in an honorable manner and was separated 2 days before completion of 3 years of active Federal service. The applicant requests correction of military records as stated in the application to the Board and as restated herein. A DA Form 4187 (Personnel Action) dated 27 April 1994 shows the applicant was reduced to Sergeant, E-5 effective 26 April 1994. His DD Form 214 (Certificate of Release or Discharge from Active Duty) apparently erroneously shows the separation authority as Army Regulation 635-200, chapter 4, the narrative reason for separation as completion of required active service, and...
