2. The applicant requests that his reentry (RE) code of
RE-3 be corrected to RE-1.
3. The applicant states that he believes he was assigned an RE-3 code in error. He was released from active duty at the expiration of his term of service (ETS), which is confirmed by his DD Form 214, Certificate of Release or Discharge from Active Duty, item 28, Narrative reason for separation, and item 26, Separation code.
4. The applicant's military records show that he enlisted in the Regular Army on 30 August 1977, was awarded the military occupational specialty of combat engineer, and was promoted to pay grade E-4.
5. He was honorably released from active duty on 29 August 1980 and transferred to the USAR Control Group (Reinforcement). His DD Form 214 shows that he served 3 years of active duty, had no lost time, was honorably released from active duty at the expiration of his term of service, and was assigned an RE code of RE-3.
6. The applicant is currently serving as a reservist assigned to a troop program unit in pay grade E-4.
7. Army Regulation 601-210, table 3-6, lists the various RE codes and describes the reason(s) a soldier is assigned a particular code. The code of RE-1 is assigned to individuals who complete an initial term of active service and who were fully qualified to reenlist when last separated. The code of RE-2 is assigned to individuals who were separated before completing a contracted period of service whose reenlistment is not contemplated. Individuals who are assigned a code of RE-2 are fully qualified to reenlist without a waiver. The code of RE-3 applies to persons not qualified for continued Army service, but the disqualification is waivable. Certain persons who have received nonjudicial punishment are so disqualified, as are persons with bars to reenlistment, and those discharged under the provisions of chapters 9, 10, 13, and 14 of Army Regulation 635-200.
CONCLUSIONS:
1. The applicant's records show he honorably completed all of his 3-year enlistment and was promoted to pay grade
E-4. He had no disciplinary record and there is no record of any adverse administrative action, such as nonjudicial punishment or a bar to reenlistment being imposed against him. All in all, his record indicates unblemished service.
2. The applicant's records do not contain any apparent reason why he would have been assigned an RE-3 code.
3. Since he completed his enlistment and had an unblemished record, it appears he should have been assigned an RE-1 code.
4. In view of the foregoing, it appears the applicant was assigned an RE-3 code in error and it would be in the interest of justice to correct his records as recommended below.
RECOMMENDATION:
That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was assigned an RE code of RE-1 upon his release from active duty on 29 August 1980.
