2.  The applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) be changed to show that his rank and pay grade at the time of his discharge on 30 November 1994 was Sergeant First Class (SFC), pay grade E-7, vice Staff Sergeant (SSG), pay grade E-6; and that this form be changed to show award of the Army Commendation Medal (ARCOM) 3d oak leaf cluster (OLC), vice ARCOM 2nd OLC. 

3.  The applicant states that his DD Form 214 was prepared prior to his promotion to SFC and prior to the amendment of the order awarding him the ARCOM.

4.  Total Army Personnel Command (PERSCOM) order number 
21-37, dated 8 November 1994, indicates that the applicant was promoted to SFC effective and with a date of rank of 
1 December 1994.  So much of that order concerning the applicant was revoked by PERSCOM on 24 June 1996. 

5.  A 16 June 1995 Fort Knox, Kentucky endorsement to a 
30 November 1994 permanent order shows that the applicant was awarded the ARCOM 3d OLC.

6.  The applicant was discharged from the Army on 
30 November 1994 as a Staff Sergeant, pay grade E-6, one day prior to the effective date of his promotion to SFC E-7, in order to accept an appointment as a warrant officer.  

7.  The applicant was appointed as a Reserve warrant officer of the Army on 1 December 1994.  

CONCLUSIONS:

1.  The applicant was awarded the ARCOM 3d OLC and his 
DD Form 214 should be changed accordingly.

2.  The applicant’s rank and pay grade, Staff Sergeant E-6, at the time of his discharge on 30 November 1994, is correct.   

3.  In view of the foregoing findings and conclusions, it would be appropriate to correct the applicant’s record as recommended below.


RECOMMENDATION:

1.  That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the ARCOM 3d OLC.

2.  That so much of the application as in excess of the foregoing be denied.
