APPLICANT REQUESTS: Reconsideration of his request that his records be corrected to show he was discharged due to a physical disability - Post-traumatic Stress Disorder (PTSD).

APPLICANT STATES : That he believes he had PTSD prior to his discharge.

COUNSEL CONTENDS : Counsel was silent on the issues.

EVIDENCE OF RECORD : Incorporated herein by reference are military records which are summarized in a memorandum presented before this Board on 16 November 1988 (COPY ATTACHED).

On 17 November 1992, a VA Rating Decision denied the applicant a service-connected disability rating for PTSD; however, he was awarded 0 percent, for hemorrhoids, effective 7 February 1992.

On 19 May 1997, the medical advisor for the DA Military Review Boards Agency opined (COPY ATTACHED) that the applicant was evaluated specifically for PTSD and his claim denied by the VA and that there is insufficient evidence to prove that he had PTSD.

DISCUSSION : Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, and advisory opinion, it is concluded:

1. In order to justify correction of a military record, the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust.

2. The applicant has failed to submit evidence that would satisfy the aforementioned requirement.

3. The applicant has provided no documentary evidence nor is their any in the Official Military Personnel File.

4. In view of the foregoing, there is no basis upon which to grant the applicant’s request.
DETERMINATION : The original decision by this Board is reaffirmed.
