APPLICANT REQUESTS: In effect, the applicant requests that his undesirable discharge be upgraded to honorable.

APPLICANT STATES : That he was AWOL for a total of 10 days out of an otherwise exemplary service of almost three years. He was a severe alcoholic and never received any help. He was wrongfully advised to sign a waiver for discharge. The severity of the undesirable discharge for 10 days for being AWOL is not tantamount to justice being served.

NEW EVIDENCE OR INFORMATION : Incorporated herein by reference are military records which were summarized in a memorandum prepared to reflect the Board’s original consideration of his case on 20 October 1982.

DISCUSSION : Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, and advisory opinion(s), it is concluded:

1. The applicant’s request for reconsideration contained no information that had not been previously known. He has submitted neither probative evidence nor a convincing argument in support of his request.

2. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy the aforementioned requirement.

3. In view of the foregoing, there is no basis for granting the applicant’s request.

DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.

BOARD VOTE:

GRANT

GRANT FORMAL HEARING

DENY APPLICATION

                                                      Karl F. Schneider
                                                      Acting Director

The psychiatrist recommended that the applicant be administratively separated under the appropriate regulation. A review of the available record fails to show that the applicant ever applied to the Army Discharge Review Board for an upgrade of his discharge within that board's 15-year statute of limitations. Additionally, there is no evidence in his record that shows he requested and was denied extended leave as he contends or that he was told that his discharge would be upgraded if he...
