GENERAL: The applicant appeals for upgrade of discharge to honorable.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDING: The Board denies the upgrade of the discharge.

ISSUE: Applicant received an Entry Level Separation for Failure to make Satisfactory Progress

Applicant contends the reason for discharge is improper because he was not in an entry level status when he was discharged. The record indicated the applicant entered active duty on 11 September 2012. He was notified of his commander's intent to discharge him on 5 March 2013 after 176 days of service and discharged on 5 April 2013. IAW AFI 36-3208, paragraph 1.19 "Airmen are in entry level status during the first 180 days of continuous active duty service. Determine the member's status by the date of notification; thus, if the member is in entry level status when initiating the separation action, describe it as an entry level separation". Although the applicant was discharged after 180 days of continuous active duty service, he was properly notified prior to the 180 day mark. The characterization of the discharge received by the applicant was found to be appropriate.

CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.
