AIR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE

GENERAL: The applicant appeals for upgrade of discharge to honorable, to change the reason and
authority for the discharge, and to change the reenlistment code.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to
exercise this right.
The attached brief contains available pertinent data on the applicant and the factors lcading to the discharge.
FINDINGS: Upgrade of discharge, change of reason and authority for discharge, and change of
reenlistment code are denied.
The Board finds that neither the evidence of record nor that provided by the applicant substantiates an
inequity or impropriety that would justify a change of discharge.
ISSUE:
Although not explicitly stated, applicant contends his discharge was inequitable because it was too harsh.
He admits that he made bad decisions and wished he had exercised better judgment. He has expressed a
desire to upgrade his discharge to allow for reenlistment into the armed forces. 'I'he records indicated the
applicant received two Articles 15, a Vacation, two Letters of Reprimand, two Letters of Counseling, a
Letter of Admonishment, and two Records of Individual Counseling for misconduct. Applicai~t received his
first Article 15 for failing to escort visitors at all times while on Beale Air Force Base. He was punished
with a suspended reduction in grade to Airman, forfeiture of pay, and a reprimand. The Vacation action for
failure to go to appointed place of duty resulted in a forfeiture of pay. The second Article 15 was for failure
to properly insure his vehicle; making a false official statement; and altering an insurance card. He was
puilished with a reduction in grade to Airman Basic and a reprimand. Applicant had other misconduct in
which he was administratively disciplined for dereliction of duty, safety violation, making a false statement,
having an unescorted female in his dorm room, and disobeying a direct order. The DRB opined that through
these administrative actions, the applicant had ample opportunities to change his negative behavior. The
Board concluded the misconduct was a signiiicant departure from conduct expected of all military members.
The characterization of the discharge received by the applicant was found to be appropriate.
CONCLUSIONS: The Discharge Review Board concludes that the discharge was coilsistent with the
procedural and substantive requirements of the discharge regulation and was within the discrction of the
discharge authority and that thc applicant was provided full administrative due process.
In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for
upgrade of discharge, thus the applicant's discharge should not be changed.

I was rec~ntly discharged from the
United States Air Force. I am writing this letter to petition the change of my Re-
enlistment code. I would like to explain my circumstances that led to my discharge.
During my enlistment, I received 2 Article 15's and various additional paperwork.
The first Article 15 was issued after an incident involving improperly escorting
visitors on base. I had driven my brother in law who is a military dependant and 3 of his
friends on base, I had made arrangements with my mother in law to pick up the children
the following day after her shift. I did not forecast this to be an issue as she worked on
base and it was her son. During this time my wife and I had left for a baseball game that
was out of the area. There was an incident during that same time where the children were
reported to have been seen smoking cigarettes. These charges were never substantiated
and were dropped. The Article 15 was issued because I was off post when the children
got into trouble, First let me say, I understand that because they were brought on base
under my responsibility. I assumed that it was not an issue because I was simply trying to
help out my mother in law and needless to say did not expect things to happen as they
did.
The 2"* Article 15 was issued for failure to maintain insurance on my automobile.
This was brought about by a minor traffic accident between myself and another co
worker. It was agreed upon by both parties to keep everything in house and without
police involvement. My supervisor at the time asked me if I had insurance and for some
ridiculous reason I told him that I did when I in truth did not, He later told me that I
needed to bring my proof of insurance to his house after duty hours. I found the request
odd but complied with it anyways. When I arrived I had a insurance card that I had
changed the dates on. I admit that it was a dumb move on my part and I could not even
begin to explain what was running through my mind at the time. At the time my wife
was in her third trimester of her pregnancy and I was concerned that if I did not provide
some sort of documentation that I would be discharged, leaving my family without
medical benefits. As it turned out, that was exactly what happened. My family has had to
struggle with the consequences of my actions since then.
I regret making the decisions that I did and wish that I had excised better judgment
and been able to continue providing a stable life and environment for my wife and
daughter. I am requesting that my re enlistment code be upgraded so that I can enlist in
the reserves and continue to serve my country and provide for my family. I know that if
afforded the oppokunity I will strive to exemplify the core values and expectations
required of all Air Force personnel. I understand what is required and am willing to
dedicate myself completely to the Air Force mission. Please give me a second
opportunity to serve and defend this great country and prove myself to be a responsible,
dependable Airman who has the strongest desire to serve and support the United States
Air Force and my family. Thank you for your time and consideration.
