GENERAL: The applicant appeals for upgrade of discharge to honorable.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to
exercise this right.
The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDINGS: Upgrade of discharge is denied.
The Board finds that neither the evidence of record nor that provided by the applicant substantiates an
inequity or impropriety that would justify a change of discharge.
ISSUE:
Issue 1. Applicant contends discharge was inequitable because it was too harsh and that the minor mishaps
that took place were after his scheduled separation date of November 27,200 1. However, due to the
implementation of the Stop Loss Program, his separation date was extended indefinitely. The records
indicated the applicant received an Article 15 for failures to go on November 6, 20, and 29-30,2001,
resulting in forty-five days extra duty. Applicant had four Letters of Reprimand for failure to go, caused
self-injury, disrespect to a superior commissioned officer, sleeping on duty, failure to maintain standards of
discipline and misuse of a government computer. Applicant had one Letter of Counseling for failure to go
while he was working on his car stereo during the duty day, despite previous warnings and during feedback
sessions. Applicant notes the minor mishaps happened after his scheduled Date of Separation (DOS). The
DRB made note of this and also considered that applicant had seven disciplinary infractions prior to his
scheduled DOS. The DRB opined that through these administrative actions, the applicant had ample
opportunities to change his negative behavior. The Board concluded the misconduct was a significant
departure from conduct expected of all military members. The characterization of the discharge received by
the applicant was found to be appropriate.
Issue 2. The applicant cited his desire to receive the G.I. Bill benefits as justification for upgrade. The DRB
noted that when the applicant applied for these benefits, he signed a statement (DD Form 2366, on
December 8, 1997) that he understood he must receive an Honorable discharge to receive future educational
entitlements. The Board was sympathetic to the impact the loss of these benefits was having on the
applicant, but this is not a matter of inequity or impropriety which would warrant an upgrade.
CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.
In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for
upgrade of discharge, thus the applicant's discharge should not be changed.

To Whom It May Concern:
I'm writing to request an upgrade to my discharge and to receive
documents stating I served my first term honorably.
My date of separation from the USAF was supposed to be November 27,
2001. Because of the tragic event that occurred on September 1 1,2001, I was prohibited
by the Stop Loss Program to separate on my date of separation. This prevented me from
accepting career job opportunities available to me around my Separation Date and also
prevented me from furthering my education. On February 2nd, 2002 I was given a General
Discharge (Under Honorable Conditions) because of minor mishaps that took place after
my original separation date. I f d y believe that my discharge should be updated to an
honorable discharge due to these circumstances.

I was informed by the VA that I needed to have my certification stating
that I served my 4 years honorably. Because of the September 11 event that occurred I
was unable to receive my certification. My DD-214 states that I received the Longevity
Award which clearly states that I served my 4 years honorably.

SUBJECT: Notification Memormdum
1. I am recommending your discharge from the United States Air Force for a Pattern of
Misconduct Consisting of Conduct Prejudicial to Good Order and Discipline. The authority for
this action is AFPD 36-32 and AFT 36-3208, Chapter 5, Section H, paragraph 5.50.2. If my
recommendation is approved, your service will be characterized as honorable or under honorable
conditions (general). I am recommending that your service be characterized as an under
honorable conditions (general).
2. My masons for this action are as follows:
a. Between on or about 6 Jan 02 and between on or about 11 Jan 02, you failed to report at
the time prescribed to your appointed place of duty, caused self-injury without intent to avoid
service, and displayed disrepect toward a superior commissioned officer. This incident resulted
in a Letter of Reprimand, dated 13 Jan 02 (Tab B).
b. Between on or about 6 Nov 01 and between on or about 30 Nov 01, you failed to report at
the time prescribed to your appointed place of duty. This incident resulted in Nonjudicial
Punishment under Article 15, Uniform Code of Military Justice, dated 18 Dec 01 (Tab C).
c. On 13 Oct 01, you were derelict in the performance of your duties. More specifically, you
wrapped up in a sleeping bag and slept in your work place. This incident resulted in a Letter of
Reprimand, dated 22 Oct 01 (Tab D).
d. On 18 Jm 01, you failed to maintain standards of discipline in regards to maintenance of
government quarters and facilities. This incident resulted in a Letter of Reprimand, dated
18 Jun 0 1 (Tab E).
e. On 8 May 01, you failed to report at the tirne prescribed to your appointed place of duty.
More specifically, you were in the parking lot working on your vehicle during your prescribed
duty time. This incident resulted in a htter of Counseling, dated 13 May 01, This document
was placed in your Unfavorable Information File, dated 30 May 01 (Tabs F & G).
f. Between on or about 11 May 01 and between on or about 13 May 01, you failed to
report at the time prescribed to your appointed place of duty. This incident resulted in a

g. On 13 May 01, you were derelict in the performance of your duties. More specifically,

3. Copies of the documents to be forwarded to the separation authority in support of this
recommendation are attached, The commander exercising Special-Court Martial (SPCM)
jurisdiction or a higher authority will decide whether you will be discharged or retained in the Air
Force and, if you are discharged, how your service will be characterized. If you are discharged,
you will be ineligible for reenlistment in the Air Force, and any special pay, bonus, or education
assistance finds may be subject to recoupment.

7. You have been scheduled for a medical examination. You must report to the 6th Medical
Group Hospital - Physical Exams, at 1400 hours on 24 Jan 02 for the examination. You must
report to the Physical Exams Section 30 minutes prior to pick up your DD Form 2697.
8. Any personal information you funish in rebuttal is covered by the Privacy Act of 1974. A
copy of AFI 36-3208 is available for your use in the Orderly Room.
