APPLICANT REQUESTS THAT:
His records be corrected to reflect award of the Global War on
Terrorism Expeditionary (GWOT-E) Medal.

APPLICANT CONTENDS THAT:
He meets the requirements for the GWOT-E. He was skipped over
due to the timeframe of the creation of the award and his
separation from active duty.
The applicants complete submission, with attachments, is at
Exhibit A.

STATEMENT OF FACTS:
On 11 Aug 99, the applicant commenced his enlistment in the
Regular Air Force and served on active duty until 10 Aug 2003,
when he was honorably discharged.
The remaining relevant facts pertaining to this application are
described in the letter prepared by the Air Force office of
primary responsibility (OPR), which is attached at Exhibit C.

AIR FORCE EVALUATION:
AFPC/DPSID recommends denial indicating there is no evidence of
an error or injustice. The applicants records indicate that he
was awarded the Armed Forces Expeditionary Medal (AFEM) for his
deployment to Al Dhafra Air Base, United Arab Emirates, from
14 Dec 01 through 27 Jan 02 in support of Operations SOUTHERN
WATCH and ENDURING FREEDOM. While the GWOT-E is awarded to
service members who have deployed abroad to specific areas of
eligibility (AOE) in support of the GWOT on or after 11 Sep 01,
awarding the GWOT-E to the applicant in addition to the AFEM
would constitute dual recognition as he was already awarded the
AFEM for said deployment.
A review of the applicants military personnel records verified
his entitlement to the GWOT Service Medal (GWOT-S) and the Air
Force Expeditionary Service Ribbon with Gold Border (AFESR
w/GB). His records will be administratively corrected to
reflect these awards.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 28 May 13, for review and comment within 30 days
(Exhibit D). As of this date, no response has been received by
this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicants complete submission in judging the merits of
the case. The applicant is requesting award of the GWOT-E for
his for his participation in support of the Global War on
Terrorism. However, we are not persuaded by the evidence
provided that he was entitled to the GWOT-E. The applicants
records reflect he has received recognition for his deployment
in support of the Global War on Terrorism by award of the AFEM.
Thus, awarding the applicant the GWOT-E would violate the
Department of Defenses (DOD) policy on dual recognition.
Therefore, we agree with the opinion and recommendation of the
Air Force office of primary responsibility (OPR) and adopt its
rationale as the basis for our conclusion the applicant has not
been the victim of an error or injustice. Therefore, in the
absence of evidence to the contrary, we find no basis to
recommend granting any relief beyond that rendered
administratively.

THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not
demonstrate the existence of material error or injustice; the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
