APPLICANT REQUESTS THAT:

His debt of $594.00 for Servicemember’s Group Life Insurance (SGLI) coverage be remitted.

APPLICANT CONTENDS THAT:

He is a member of the Participating Individual Ready Reserve (PIRR) and was never notified that he was enrolled in SGLI.  He has been charged $27.00 a month since 11 Feb 2001 for a service he did not request.

Because he is a PIRR member and only works for points, not pay, he had no reason to check a pay statement and came across this information while checking his Navy civilian pay statement.

He has yet to receive any notification of the debt and believes this is unfair and should not have to pay for a service that he was unaware of nor desires.  

In support of his request, the applicant provides a copy of his Reserve Order, Number DA-00504, dated 13 Jan 2009, and his Defense Finance and Accounting Service (DFAS) Military Leave and Earning Statement.

STATEMENT OF FACTS:

On 10 Jan 2009, the applicant became a member of the PIRR.

Members of the PIRR are covered under SGLI unless they complete the required paperwork to decline coverage as prescribed by United States Code (U.S.C), Title 38 Subchapter 1967(a)(2)(A).

AIR FORCE EVALUATION:

ARPC/DPTT recommends denial.  DPTT states that members of the PIRR are covered under SGLI unless they complete the required paperwork to decline coverage as prescribed by U.S.C. Title   38, Subchapter 1967.  There is no documentation available to indicate the applicant declined or reduced SGLI coverage in writing. Furthermore, the applicant received notification from DFAS for SGLI coverage debt of $594.00 from Feb 2011 to Nov      2012.  SGLI monthly premiums are automatically deducted from the service member’s base pay and service members are responsible for paying premiums by making applicable arrangements if not receiving pay.  If the member had passed away prior to declining coverage, the SGLI coverage of $400,000 would have been paid to his designated beneficiary.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 8 Mar 2013 for review and comment within 30 days (Exhibit C).  As of this date, this office has not received a response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice.  We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.  Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
