APPLICANT REQUESTS THAT:

1. Her DD Form 214, Certificate of Release or Discharge from Active Duty, be corrected to add the Korean Defense Service Medal (KDSM) and the Overseas Short Tour ribbon (Administratively Corrected).   

2. The Air Force Long Tour ribbon be added to her DD Form 214.
 
3. Her DD Form 214 be corrected to reflect her entire active duty service dates. 

4. Her Foreign Service time be changed from 2 years, 22 months and 2 days to 3 years and 4 days.

APPLICANT CONTENDS THAT:

1.  The overseas long tour ribbon was omitted based on incorrect Foreign Service time on her DD Form 214.  She served a long tour in Italy, from 1 Feb 1975 to 7 Feb 1977. 

2. She was not issued a DD Form 214 that covered her previous enlistment in 1973 and 1981.   

In support of her request, the applicant provides copies of her DD Form 214, permanent change of assignment orders and special order awarding the Air Force Commendation Medal.

STATEMENT OF FACTS:

The applicant’s military service records reflect two DD Forms 214 for the periods of 26 Jul 1973 to 11 Aug 77 and for 13 Jul 1981 to 21 Dec 1984.

The Air Force Long Tour ribbon was authorized by the Chief of Staff, U.S. Air Force, 12 Oct 80. Before 6 Jan 86, the ribbon was awarded to Air Force and Air Force Reserve members credited with completion of an overseas tour on or after 1 Sep 80. Air Force and Air Force Reserve members serving as of 6 Jan 86 or later are entitled to reflect all Air Force overseas tours credited during their career. A service member may wear both ribbons, if appropriate. The short tour ribbon takes precedence over the long-tour ribbon when both are worn.

AIR FORCE EVALUATION:

AFPC/DPSID recommends denial of the applicant’s request for the Overseas Long Tour ribbon.  The applicant completed her long tour prior to the establishment date for the award.  Furthermore, she was not on active duty on 6 Jan 1986 to qualify for the award under the retroactive provision.  To grant the applicant relief would be contrary to the eligibility criteria established by DoDM 1348.33, Manual of Military Decorations and Awards: DoD Service Awards, Campaign, Expeditionary and Service Medals. 

DPSID will administratively correct the applicant’s records to show award of the KDSM and the Overseas Short Tour ribbon.

AFPC/DPAPP recommends denial of granting the applicant’s request to correct her DD Form 214 to show 3 years and 4 days of Foreign Service.  DPAPP reviewed the applicant’s military service records and verified foreign service time in Italy from 1 Feb 1975 to   12 Jan 1977, for 1 year, 11 months and 12 days; Kunsan Air Base Republic of Korea, from 11 Aug 1981 to 9 Aug 1982, for a period of 11 months and 30 days; for a combined total foreign service time of 2 years, 11 months and 12 days.  This is less than that currently reflected.  DPAPP will administratively correct the DD Form 214 upon conclusion and final decision of the Board.

AFPC/DPSIPV states that the applicant’s DD Form 214 reflects an incorrect Date Entered Active Duty (Item 12a) and will be corrected to read 12 Aug 77.  Her Net Active Service (Item 12c) and Total Prior Active Service (Item 12d) will be corrected to show the correct amount of service for those categories.  Additionally, periods of time already captured on a previous DD Form 214 cannot be combined as though they are only one period. However, both the DD Form 214 and DD Form 215, Correction to the DD Form 214, reflects the applicant’s full service time.

APPLICANT’S REVIEW OF AIR FORCE EVALUATION:

Copies of the Air Force evaluations were forwarded to the applicant on 21 Jun 2013 for review and comment within 30 days (Exhibit E).  As of this date, this office has not received a response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or regulations.

2.  The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented to demonstrate the existence of error or injustice.  We took notice of the applicant's complete submission in judging the merits of the case; however, we agree with the opinions and recommendations of the Air Force offices of primary responsibility and adopt its rationale as the basis for our conclusion that the applicant has not been the victim of an error or injustice.  Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not demonstrate the existence of material error or injustice; that the application was denied without a personal appearance; and that the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
