APPLICANT REQUESTS THAT:
His initial request for Post-9/11 GI Bill Transfer of Education
Benefits dated 17 September 2010 (TEB) be reinstated.

APPLICANT CONTENDS THAT:
1. He transferred his Post-9/11 education benefits to his weife
and daughter on 25 October 2010. After his application, he
received no email to sign additional documentation and assumed
the process was complete.
2. On 8 Nov 12, he received an email stating that his Statement
of Understanding (SOU) was not signed. In order to transfer the
benefits now he would incur a 4 year Active Duty Service
Commitment (ADSC). Currently he has 19 years of active duty and
plans on retiring in two years.
In support of his request, the applicant provides a copy of his
Submit Transfer Request and email communications.
His complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
The applicant is currently serving on active duty in the grade
of major.

AIR FORCE EVALUATION:
AFPC/DPSIT recommends denial. On 25 Oct 12, an email was sent
to the applicant requesting him to sign the SOU; however, he
never signed the SOU or attempted to follow-up by contacting the
Total Force Serve Center (TFSC) to see if his application was
complete. The email that was sent to the applicant specifically
states the steps to take in order to process and complete his
TEB application. It is clear the applicant failed to complete
the process by not submitting the SOU. Additionally, on 12 Nov
10, another email was sent to the applicant notifying him that
his TEB application had expired because he did sign the SOU.
Without signing the SOU, the TFSC has no way of knowing if the
applicant agrees to the 4-year ADSC that goes along with the
TEB.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 11 Jan 13 for review and comment within 30 days.
As of this date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we agree with the opinion and recommendation
of the Air Force office of primary responsibility and adopt its
rationale as the basis for our conclusion that the applicant has
not been the victim of an error or injustice. Therefore, in the
absence of evidence to the contrary, we find no basis to
recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered

Under the Transfer of Education Benefits (TEB) website, it notifies the applicants that their transfer request is not final until the SOU is digitally signed in the Virtual Military Personnel Flight (vMPF). On 12 Oct 10, an email was sent to the applicant informing her that her application for TEB had expired because she did not sign the SOU. As of this date, no response has been received by this office (Exhibit D).
