APPLICANT REQUESTS THAT:
She be allowed sufficient time to build a competitive record for
promotion to colonel (O-6).

APPLICANT CONTENDS THAT:
She was recently promoted to the grade of lieutenant colonel (Lt
Col) (O-5) by a Special Selection board (SSB) with a retroactive
date of rank (DOR) of 1 December 2008 making her immediately
eligible for promotion to colonel. Her record will not be
competitive for promotion as she will have no chance to gain
command experience or complete Senior Developmental Education
(SDE).

STATEMENT OF FACTS:
The applicant is currently serving in the Regular Air Force in the
rank of lieutenant colonel with a DOR of 1 December 2008.
The remaining relevant facts, extracted from the applicants
military service record, are contained in the evaluation provided
by the Air Force office of primary responsibility at Exhibit C.

AIR FORCE EVALUATION:
AFPC/DPSOO recommends approval. DPSOO states the applicant met
the 14 May 2012 SSB for consideration by the Calendar Year 2007B
(CY07B) Lt Col Central Selection Board (CSB) that had convened
on 27 November 2007. She was selected for promotion with a DOR
and effective date of 1 December 2008. Based on her DOR as a Lt
Col, she is eligible to meet the CY13C Colonel CSB scheduled to
convene on 4 November 2013 as an In-the-Zone (IPZ) eligible.
They concur with approving the applicants request to allow
sufficient time to build a competitive record for promotion to
colonel. This relief has been used on other cases where
officers have been returned to active duty after being
retroactively promoted by an SSB and for officers on active duty
who are retroactively promoted and immediately eligible for the
next higher grade. This would be the best relief for the
applicant. The record should be corrected to show any
nonselections for promotion to the grade of colonel prior to
receiving three Officer Performance Reports (OPRs) with at least
250 days of supervision, in the grade of Lt Col, be set aside.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the
applicant on 17 December 2012, for review and comment within
30 days (Exhibit D). As of this date, this office has received
no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to
demonstrate the existence of an injustice warranting relief.
After a thorough review of the evidence presented, it appears
the applicants recent promotion to the grade of lieutenant
colonel by an SSB with a retroactive DOR of 1 December 2008,
puts her in a situation that does not allow her to build a
competitive record prior to meeting her IPZ colonel promotion
board. As a result, we believe this creates an injustice which
should be remedied. Therefore, we agree with the recommendation
made by the Air Force office of primary responsibility and
recommend the applicants record be corrected as indicated
below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air
Force relating to APPLICANT be corrected to reflect that any
nonselections for promotion to the grade of colonel (O-6) prior
to receiving three Officer Performance Reports with at least 250
days of supervision, in the grade of lieutenant colonel (O-5),
be set aside.

While the applicant contends that his three-year break in service, during which he served in the Air Force Reserve, caused him to be considered IPZ three years earlier than his commissioning year group, reserve officers ordered to active duty maintain their rank and DOR.
