RECORD OF PROCEEDINGS

AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS

IN THE MATTER OF: DOCKET NUMBER: BC-2012-04074

 COUNSEL: NONE

 HEARING DESIRED: NO

________________________________________________________________

APPLICANT REQUESTS THAT:

His 23 July 2010 Fitness Assessment (FA) score be removed from
the Air Force Fitness Management System (AFFMS).

________________________________________________________________

APPLICANT CONTENDS THAT:

His failure was due to the test administrator inaccurately
counting his push-ups and sit-ups. The unit fitness program
manager stated his test would be removed after having his
technique evaluated and retesting. However, the failure was not
removed after passing another test.

The applicant’s complete submission, with attachment, is at
Exhibit A.

STATEMENT OF FACTS:

The applicant is currently serving in the Regular Air Force in
the grade of master sergeant (E-7).

On 23 July 2010, the applicant participated in the contested FA
and attained an overall score of 81.80; however, as his sit-up
component was recorded as 33, which is below the minimum
required for this component (34). As a result, he attained an
overall unsatisfactory assessment.

AIR FORCE EVALUATION:

AFPC/DPSIM recommends denial, noting the applicant did not
provide any documentation to substantiate his assertion. While
the applicant provided documentation indicating there was an
agreement to allow him to retest after the contested FA, there
is no documentation to indicate that his performance in the sit-
up component of the contested FA was erroneously measured or
recorded. A memorandum was sent to the applicant requesting a
signed memorandum for the Fitness Assessment Cell stating they
counted the sit-ups and push-ups incorrectly. The applicant did
not provide the requested documentation.

A complete copy of the AFPC/DPSIM evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the
applicant on 21 January 2013 for review and comment within 30
days. As of this date, no response has been received by this
office (Exhibit D).

 ________________________________________________________________

THE BOARD CONCLUDES THAT:

1. The applicant has exhausted all remedies provided by
existing law or regulations.

2. The application was timely filed.

3. Insufficient relevant evidence has been presented to
demonstrate the existence of an error or injustice. After
careful consideration of applicant’s request and the available
evidence of record, we are not convinced the applicant is the
victim of an error or injustice. Other than his own
uncorroborated assertions, he has provided no evidence
whatsoever for us to consider in evaluating the merits of his
case. Therefore, in the absence of evidence to the contrary, we
find no basis to recommend granting the relief sought in this
application.

 ________________________________________________________________

THE BOARD RECOMMENDS THAT:

The applicant be notified the evidence presented did not
demonstrate the existence of material error or injustice, the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
