APPLICANT REQUESTS THAT:
His Fitness Assessment (FA) dated 16 February 2012 be removed
from his records.

APPLICANT CONTENDS THAT:
He was not given 42 days after the expiration date of his AF Form
469, Duty Limiting Condition Report, to recondition for his FA;
which resulted in an incomplete assessment score and worsened his
injury.

STATEMENT OF FACTS:
The applicant is currently serving on active duty in the grade of
senior airman.
The applicants last five FA scores are as follows:

On 9 October 2012, DPSIM advised the applicant to provide
additional supporting documentation to substantiate his claim
(i.e., AF Form 422, Notification of Air Force Members
Qualification Status) within 30 days. As of this date, this
office has received no response.

AIR FORCE EVALUATION:
AFPC/DPSIM recommends denial. DPSIM states the applicant took a
FA on 16 February 2012, scoring a composite score of 19.10, an
unsatisfactory fitness level. According to the AF Form 469,
dated 21 November 2011, the applicants physical
limitations/restrictions included no high impact activities and
no repetitive bending of the waist and back.
The applicant failed to provide a copy of the AF Form 422, Physical Profile Serial Report, to validate the effective dates
or 42-day reconditioning period of the FA components that he was
cleared to test on.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 25 January 2013, a copy of the Air Force evaluation was
forwarded to the applicant for review and response within 30 days
(Exhibit C). As of this date, no response has been received by
this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. After
thoroughly reviewing the evidence of record and noting the
applicant's contentions, we are not persuaded the contested FA is
in error or unjust. The AF Form 469 dated 21 November
2011 provided is noted; however, in the absence of a copy of his
AF Form 422, we find insufficient evidence to warrant disturbing
the record. However, should the applicant provide such evidence,
we would be willing to reconsider his request. In view of the
above and in the absence of evidence to the contrary, we find no
basis to recommend granting the relief sought in this
application.

The applicant be notified the evidence presented did not
demonstrate the existence of an error or injustice; the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.
