RECORD OF PROCEEDINGS

AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS

IN THE MATTER OF: DOCKET NUMBER: BC-2010-04763

 COUNSEL: NONE

 HEARING DESIRED: NO

_________________________________________________________________

APPLICANT REQUESTS THAT:

His reentry (RE) code of 2C (Involuntarily separated with an
honorable discharge, or entry level separation without
characterization of service) be changed to allow him to reenter
military service.

_________________________________________________________________

APPLICANT CONTENDS THAT:

He is requesting this change in order to be eligible to reenlist
in the Air Force.

In support of his request, the applicant provides a copy of his
and DD Form 214, Certificate of Release or Discharge from Active
Duty, and AF IMT 100, Request and Authorization for Separation.

The applicant's complete submission, with attachments, is at
Exhibit A.

STATEMENT OF FACTS:

On 23 Feb 10, the applicant contracted his enlistment in the
Regular Air Force. He served as a Diagnostic Imaging Helper.

On 14 Jun 10, his commander notified him that she was
recommending his discharge from the Air Force for entry-level
performance or conduct. The specific reason for the discharge
action was he was disenrolled from the Diagnostic Imaging
Apprentice course due to failing Block 3, Unit 10, Test a; and
Block 4, Unit 8, Test a.

The applicant acknowledged receipt of the notification of
discharge and, after consulting with counsel, waived his to
submit statements in his own behalf.

The legal office reviewed the case, found it legally sufficient
to support separation, and recommended separation with an entry-
level separation without probation and rehabilitation.

On 24 Jun 10, the discharge authority directed the applicant’s
discharge with an entry-level separation. He was furnished an
entry-level separation with uncharacterized serviceon 25 Jun 10.
He served four months and three days of active service.

AIR FORCE EVALUATION:

AFPC/DPSOA recommends denial, indicating the applicant has not
provided any evidence showing the RE code he received was
errorneous or unjust.

The complete AFPC/DPSOA evaluation is at Exhibit C.

APPLICANT REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant
on 4 Mar 11 for review and comment within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:

1. The applicant has exhausted all remedies provided by existing
law or regulations.

2. The application was timely filed.

3. Insufficient relevant evidence has been presented to
demonstrate the existence of an error or an injustice to warrant
changing the applicant’s RE code of “2C.” The evidence of record
indicates the applicant was given an entry-level separation with
uncharacterized service for “entry level performance and
conduct.” After a thorough review of the applicant’s complete
submission and evidence of record, we find no evidence which
would lead us to believe that his entry-level separation with
uncharacterized service was improper or contrary to the governing
instruction under which it was effected. We also find no
evidence the contested RE code, issued in conjunction with his
entry-level separation, was erroneously assigned or inaccurately
reflected the circumstances of his separation. Notwithstanding
the above, we are persuaded that corrective action is warranted
regarding the applicant’s narrative reason for separation. This
Board has previously determined in similar cases that where the
evidence appears to clearly indicate the service member was
discharged for performance and not any misconduct, the narrative
reason should be amended by deleting the words “and conduct” from
the narrative reason for separation. Therefore, in the interest

of equity and justice, we believe the applicant’s records should
be corrected as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force
relating to the APPLICANT, be corrected to show that Block 28
(Narrative Reason for Separation) on his DD Form 214, Certificate
of Release or Discharge from Active Duty, issued as a result of
his entry-level separation on 25 June 2010, be amended by
deleting the words “and conduct.”
