APPLICANT REQUESTS THAT:
His DD Form 214, Certificate of Release or Discharge from Active
Duty, be corrected to reflect his grade as senior airman (E-4)
versus airman first class (E-3).

APPLICANT CONTENDS THAT:
A clerical error was made on his discharge documents that reflect
his rank as airman first class; however, he separated as a senior
airman.
In support of his request, the applicant provides a copy of his
DD Form 293, Application for the Review of Discharge from the Armed
Forces of the United States.
His complete submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:
The applicant enlisted into the Regular Air Force on 17 Jan 90 and
was progressively promoted to the grade of airman first class (E-
3), having assumed that grade effective and with a date of rank of
17 May 91. He received an honorable discharge on 11 Mar 93 after
serving 3 years, 1 month, and 25 days on after duty.

AIR FORCE EVALUATION:
AFPC/DPSOE recommends denial. DPSOE states that they requested
additional information from the applicant; however, he has not
responded. The applicants official military records reflect he
enlisted as an airman basic for a period of 4 years and should have
been promoted to the ranks of airman on 17 Jul 90; airman first
class on 17 May 91; and based on his date of rank to airman first
class, he would have been time-in-grade/time-in-service eligible
for promotion to senior airman on 17 Jan 93 IAW the governing
regulation provided he had a 5 skill-level and his commanders
written recommendation. However, due to lack of official
documentation in his records, DPSOE cannot support his request to
correct his records to reflect he was discharged in the grade of
senior airman.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant
on 16 Jul 10 for review and comment within 30 days. As of this
date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we agree with the opinion and recommendation of
the Air Force office of primary responsibility and adopt its
rationale as the basis for our conclusion that the applicant has
not been the victim of an error or injustice. Therefore, in the
absence of evidence to the contrary, we find no basis to recommend
granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
