STATEMENT OF FACTS: 

 

On 25 Aug 09, the Board considered and denied the applicant’s 
appeal, requesting that he be awarded the AM, CRM, and VSM. A 
complete copy of the Record of Proceedings is attached at Exhibit 
F (with Exhibits A through E). 

 

By VA Form 21-4138, Statement in Support of Claim, dated 4 Jan 
10, applicant requests reconsideration of his request to include 
the RVCM, contending his AF Form 7, Airman Military Record, 
shows he served in Vietnam for 63 days. 

 

In support of the appeal, applicant submits a copy of his AF 
Form 7.

Exhibit G. 

 

 

The VSM criterion: The VSM was created by Executive Order 11213, 
8 Jul 65. It is awarded to all service members of the Armed 
Forces who between 4 Jul 65 and 28 Mar 73, served on temporary 
duty for 30 consecutive days or 60 nonconsecutive days in the 
following areas of Southeast Asia: In Vietnam and contiguous 
waters and airspace; in Thailand, Laos or Cambodia or the 
airspace thereof and in the direct support of military operations 
in Vietnam. 

 

The RVCM Criterion: This medal is awarded to members of the 
armed forces of the United States who: 1) Served for six months 
in South Vietnam during the period March 1, 1961 to March 28, 
1973; 2) Served outside the geographical limits of South Vietnam 
and contributed direct combat support to the RVN armed forces for 


an aggregate of six months. Only members of the armed forces of 
the United States who meet the criteria established for the AFEM 
(Vietnam) or Vietnam Service Medal during the period of service 
required are considered to have contributed direct combat support 
to the RVN armed forces; 3) Did not complete the length of 
service required in item (1) or (2) above, but who, during 
wartime, were: a) wounded by the enemy (in a military action); b) 
captured by the enemy during action or in the line of duty, but 
later rescued or released; c) killed in action or in the line of 
duty; 4) Were assigned in Vietnam on Jan. 28, 1973, and who 
served a minimum of 60 calendar days in Vietnam during the period 
Jan. 29 to March 28, 1973.

THE BOARD CONCLUDES THAT: 

 

In an earlier finding, we determined there was insufficient 
evidence to warrant any corrective action. After thoroughly 
reviewing the additional documentation submitted in support of 
this appeal and the evidence of record, we do not believe the 
applicant has overcome the rationale expressed in our previous 
decision regarding the VSM. In addition, we find no error or 
injustice with regard to the applicant’s request that he be 
awarded the RVCM. The applicant did not provide any documentary 
evidence to substantiate his claim or, that he was recommended 
for the RVCM. Therefore, in view of the above, and in the 
absence of evidence to the contrary, we find no basis upon which 
to recommend favorable consideration of the applicant’s request.

THE BOARD DETERMINES THAT: 

 

The applicant be notified that the additional evidence presented 
did not demonstrate the existence of material error or injustice; 
that the application was denied without a personal appearance; 
and that the application will only be reconsidered upon the 
submission of newly discovered relevant evidence not considered 
with this application.
