MEMORANDUM OF CONSIDERATION OF APPLICATION BEFORE THE AFBCMR

SUBJECT:  XXXXXXXXXXXXXXX

      Having carefully reviewed this application, we agree with the
recommendation of the Air Force office of primary responsibility and adopt
the rationale expressed as the basis for our decision that the applicant
has been the victim of either an error or an injustice.  Therefore, under
the authority delegated in AFI 36-2603, the applicant's records will be
corrected as set forth in the accompanying Memorandum for the Chief of
Staff signed by the Executive Director of the Board or his designee.

      MEMORANDUM FOR THE CHIEF OF STAFF


            Under the authority of Section 1552, Title 10, United States
      Code and Air Force Instruction 36-2603, and having assured compliance
      with the provisions of the above regulation, the decision of the Air
      Force Board for Correction of Military Records is announced, and it is
      directed that:


            The pertinent military records of the Department of the Air
      Force relating to XXXXXXXXXXXXXXXXXXXXXX, be corrected to show that:


                  a.  He was relieved from active duty and retired effective
      1 January 2000 in the grade of captain and his name was placed on the
      Retired Officer File under the provisions of Title 10 United States
      Code, Section 8966.


                  b.  Special Order No. AC-006851, dated 6 March 2000, was
      accepted for file in his Master Personnel Record Group on 6 March
      2000.


                  c.  Special Order No. AC-006851, dated 6 March 2000, be,
      and hereby is, rescinded.


                  d.  Special Order No. CJ-002962, dated 10 May 2006, be,
      and hereby is, rescinded.


                  e.  A Special Order be published reflecting that he was
      relieved from active duty effective 31 December 1999 and retired
      effective 1 January 2000 in the grade of captain; omitting remarks
      pertaining to his years of active service as an enlisted member; and
      including a Manifest Error statement.
