APPLICANT REQUESTS THAT:
His 24 days of lost leave be restored.

APPLICANT CONTENDS THAT:
Due to scheduled training, deployment and numerous other exercises, he
could not take all 30 days of earned leave during FY 2005. A class
prevented him from taking any leave in the first quarter of FY 2005.
Later, his squadron deployed in support of a mission. He was subsequently
deployed for 130 days, and his squadron participated in numerous exercises
and inspections during 2005.
In support of the application, he submits copies of his travel vouchers.

STATEMENT OF FACTS:
The applicant is currently serving on active duty in the grade of major.
According to information provided by the Air Force office of primary
responsibility, the applicant was not allowed to take his remaining
use/lose leave due to end of year training requirements. He was provided a
four-day commander’s pass in conjunction with six days of post deployment
recovery time (PDRT) for a total of 10 days. He requested an additional
week of leave following the 10 days but was denied leave due to a squadron
reactivation ceremony.

AIR FORCE EVALUATION:
HQ AFPC/DPSO recommends restoration of 14 days of leave. DPSO affirms AFI
36-3003, Military Leave Program, note below para 10.9.7, states in part
member’s application must clearly establish that an error or injustice by
the Air Force caused the member’s lost leave. Additionally, para 4.1.4,
Use of Leave, recommends members be given the opportunity to take at least
one leave period of 14 consecutive days or more each FY and encourages them
to use the 30 days of leave they accrue each year. DPSO opines the
applicant had the opportunity to take 10 days of his 24 use/lose leave but
chose to use DPRT.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 19 May
2006 for review and comment within 30 days. As of this date, this office
has received no response (Exhibit D).

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of an error or injustice. The applicant has requested 24 days of
leave be restored to his account. The Air Force office of primary
responsibility recommends we restore 14 days to his account, and we agree.
In addition, we find he is entitled to an additional seven (7) days for the
week that was cancelled due to his squadron mission. Therefore, with the
recommendation from DPSO and our recommended correction, the applicant will
be given 21 days of restored leave. The applicant should understand that
all leave days in excess of 60 must be taken by the end of the current
fiscal year.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT be corrected by adding 21 days of annual leave to his leave
account commencing 2 October 2005.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of
Section 1552, Title 10, United States Code (70A Stat 116), it is directed
that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected by adding 21 days of annual leave to
his leave account commencing 2 October 2005.
