APPLICANT REQUESTS THAT:
He receive Special Selection Board (SSB) consideration for promotion
to the grade of lieutenant colonel for the Calendar Year (CY) 2005A
Lieutenant Colonel Central Selection Board (CSB) with inclusion of his
Meritorious Service Medal (MSM) (Basic), for the period 6 March 2000
to 5 January 2005, in his officer selection record (OSR).

APPLICANT CONTENDS THAT:
He PCSd from the 22d Airlift Squadron, Travis AFB in January 2005. He
inquired into the status of his MSM in March, April, May, and July
2005. The paperwork was in progress, but the award did not enter his
record until after his “in-the-zone” promotion board. Consequently,
the promotion board would conclude he PCSd without getting an award.
In support of the appeal, applicant submits a copy of his MSM and a
copy of his Special Order.

STATEMENT OF FACTS:
The applicant is currently serving on extended active duty in the
grade of major.
Applicant was considered and not selected for promotion to the grade
of lieutenant colonel by the CY05A Lieutenant Colonel Central
Selection Board.
Applicant’s Officer Performance Reports (OPRs) from 1991 through 2005
reflect meets standards on all performance factors.

AIR FORCE EVALUATION:
AFPC/DPPPO states that in reviewing his OSR they have determined that
the applicant’s MSM awarded by Special Order (SO) GPP-473, dated 14
September 2005, was processed within the guidelines of AFI 36-2803,
paragraph 3.1. These guidelines state that decoration recommendations
are entered into official channels within two years and awarded within
three years of the act, achievement, or service performed.
Furthermore, in accordance with published guidance, the decoration
award authority announces its final decision when approving an award
by publishing special orders. These orders serve as the source
document for updating the decoration in the Military Personnel Data
System. Since the order for this decoration was published on 14
September 2005, the citation could not have been filed in his
selection record nor reflected in any of their official personnel data
systems when the board convened. The MSM did not exist when the CY05A
board convened on 6 July 2005. Therefore, they recommend denial of
applicant’s request. The absence of this decoration is not an error
since it was not required to be in his OSR prior to convening of the
CY05A board.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 3 February 2006, a copy of the Air Force evaluation was forwarded
to the applicant for review and response within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate
the existence of error or injustice. After reviewing the evidence of
record, the majority of the Board is of the opinion that although the
decoration was processed within established time restraints, the delay
in its approval was through no fault of the applicant, and could have
sent a negative message to members of the central selection board that
applicant did not receive a PCS decoration for the five-year period
preceding the CY05A Board. Further, it appears the applicant
exercised due diligence in periodically inquiring as to the status of
the decoration recommendation package. While it cannot be
conclusively determined whether or not the absence of the decoration
was the sole reason for his promotion nonselection by the CY05A Board,
we do believe that it served to deprive him of fair and equitable
consideration. Therefore, the majority of the Board recommends the
applicant’s records be corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that on 17 June 2005, he
was awarded the Meritorious Service Medal (MSM) for the period 6 March
2000 to 5 January 2005.
It is further recommended that his record, to include the MSM for the
period 6 March 2000 to 5 January 2005, be considered for promotion to
the grade of lieutenant colonel by Special Selection Board for the
Calendar Year 2005A Lieutenant Colonel Central Selection Board (CSB)
and any subsequent boards for which the above award was not a matter
of record.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:
The pertinent military records of the Department of the Air
Force relating to APPLICANT, be corrected to show that on 17 June
2005, he was awarded the Meritorious Service Medal (MSM) for the
period 6 March 2000 to 5 January 2005.
It is further directed that his record, to include the MSM for
the period 6 March 2000 to 5 January 2005, be considered for promotion
to the grade of lieutenant colonel by Special Selection Board for the
Calendar Year 2005A Lieutenant Colonel Central Selection Board (CSB)
and any subsequent boards for which the above award was not a matter
of record.
