APPLICANT REQUESTS THAT:

His records be corrected to reflect he was  awarded  the  Republic  of
Korea War Service Medal (ROKWSM) and the Korean Defense Service  Medal
(KDSM).

APPLICANT CONTENDS THAT:

He believes he is entitled to the ROKWSM and KDSM.

Applicant's complete submission is attached at Exhibit A.

STATEMENT OF FACTS:

On 6 November 1953, the applicant enlisted in the  Regular  Air  Force
(RegAF) as an airman basic (AB) for a period of four years.

The applicant’s DD Form 214  reflects  he  was  awarded  the  National
Defense Service Medal (NDSM), Good Conduct Medal (GCM).

On 6 November 1953, the applicant  was  honorably  discharged  in  the
grade of airman first class (A1C).  The applicant had 1  year  and  13
days of foreign and/or sea service.  He served four years,  two months
and three days of military service.

On 19 April 2006, a DD Form 215 was issued  adding  the  KDSM  to  the
applicant’s DD Form 214.  Therefore,  the  only  remaining  issue  for
consideration by the Board is the ROKWSM.

AIR FORCE EVALUATION:

AFPC/DPPPR recommends the applicant’s request for award of the  ROKWSM
be denied.  DPPPR states the applicant is not eligible for the  award.
They further state to be awarded the  ROKWSM  military  veterans  must
have served in the  country  of  Korea,  its  territorial  waters,  or
airspace within the inclusive period of 25 June 1950 - 27  July  1953.
Their service must have been performed while on  permanent  assignment
in Korea or while on temporary duty in Korea for 30 consecutive or  60
nonconsecutive days or as a crewmember of aircraft  in  aerial  flight
over Korea participating in actual combat operations, or in support of
combat operations.

Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the  applicant  on
28 April 2006, for review and response.  As of this date, no  response
has been received by this office.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was not  timely  filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the existence of an error or an injustice.   We  took  notice  of  the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinion and the recommendation of  the  Air
Force and adopt its rationale as the basis for our conclusion that the
applicant has not been the victim of an error or  an  injustice.   The
ROKWSM is awarded to servicemembers who have served  in  Korea  during
the period of 25 June 1950 through 27  July  1953.   Furthermore,  the
servicemember had to be assigned in Korea or on TDY for 30 consecutive
or 60 nonconsecutive days, or served as a crewmember of an aircraft in
aerial flight over Korea participating in actual combat operations  or
in support of combat operations.  The applicant’s records  reflect  he
was not assigned in Korea during the  time  period  required  for  the
ROKWSM.  Therefore, in the absence of the evidence  to  the  contrary,
the Board finds no compelling basis to recommend granting  the  relief
sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
