APPLICANT REQUESTS THAT:

His records be corrected to reflect he  was  tendered  a  Regular  Air
Force appointment as an exception to policy.

APPLICANT CONTENDS THAT:

He previously received a Regular  commission.   He  finished  his  Air
Force commitment and was honorably discharged.   He  has  returned  to
active duty with  a  Reserve  commission.   He  is  requesting  he  be
tendered a Regular commission so that he can continue  his  Air  Force
career past 20 years of active service.

In support of his  appeal,  the  applicant  provided  a  statement  of
support, copies of  his  separation  documents,  and  other  documents
associated with the matter under review.

STATEMENT OF FACTS:

Applicant’s available  military  personnel  records  indicate  he  was
voluntarily ordered to extended active duty on  14  Nov  85.   He  was
honorably discharged 13 May 00 in the grade of major.  He was credited
with 14 years and 6 months of active  service.   He  was  subsequently
appointed as an officer in the Air Force Reserve.

He was voluntarily ordered to extended  active  duty  on  26  Jan  04.
Information extracted from the Personnel Data System  (PDS)  indicates
he is currently serving on active duty  in  the  grade  of  lieutenant
colonel, with a current grade date of rank of 4 Sep 03.

AIR FORCE EVALUATION:

AFPC/DPPPOO indicated that based  on  the  applicant’s  situation  and
information  provided  by  the  applicant  and  his  commander,   they
recommend approval of the applicant’s request for a Regular Air  Force
appointment.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to  applicant  on  24
Sep 04 for review and response.  As of this date, no response has been
received by this office (Exhibit ).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to demonstrate the
existence of error  or  injustice.   Having  carefully  reviewed  this
application, a majority of the Board agrees with the recommendation of
AFPC/DPPPOO that the applicant should be tendered a Regular Air  Force
appointment.  The majority notes the applicant is  serving  on  active
duty in a critically manned career field and desires  to  continue  to
serve beyond 20 years of service.  His retention is strongly supported
by his commander.  In view of the above, and since it appears he  will
not have an opportunity to be offered a Regular Air Force  appointment
prior to his retirement date, the  majority  agrees  with  AFPC/DPPPOO
that it would be in the best interest of the Air Force to  retain  the
applicant  on  active  duty  beyond  20  years  of   active   service.
Therefore,  the  majority  recommends  the  applicant’s   records   be
corrected to reflect he was tendered a Regular Air Force  appointment,
as an exception to policy.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the  Department  of  the  Air  Force
relating to APPLICANT, be corrected to show that:

      a.  Competent authority approved his request for a  Regular  Air
Force appointment as an exception to policy and action be initiated to
obtain Senate confirmation.

      b.  Upon Senate confirmation, he be tendered a Regular Air Force
appointment.

By a majority vote,  the  Board  voted  to  correct  the  records,  as
recommended.  Ms. Willis voted to deny relief but did  not  desire  to

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air
Force Board for Correction of Military Records and under the authority
of Section 1552, Title 10, United States Code (70A Stat 116), it is
directed that:

      The pertinent military records of the Department of the Air
Force relating to , be corrected to show that:

            a.  Competent authority approved his request for a Regular
Air Force  appointment  as  an  exception  to  policy  and  action  be
initiated to obtain Senate confirmation.

            b.  Upon Senate confirmation, he be tendered a Regular Air
Force appointment.
