APPLICANT REQUESTS THAT:
His DD Form 214, Report of Separation from Active Duty, issued in
conjunction with his 15 October 1973 release from active duty, be amended
to include the Vietnam Service Medal (VSM).

THE APPLICANT CONTENDS THAT:
While assigned to the 824th Security Police Squadron, he performed over 90
days of TDY in Vietnam.
In support of the appeal, applicant submits copies of his TDY orders.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force on 9 April 1970.
Headquarters 824th Combat Support Group special order TD-1479 assigned him
TDY to the 377th Air Base Wing, Tan Son Nhut AB, Republic of Vietnam, for a
period of approximately 60 days, for manning assistance. He was released
from active duty on 15 October 1973, under PALACE CHASE. He completed 3
years, 6 months, and 7 days of active service that included 1 year, 5
months, and 28 days of foreign and or Southeast Asia service.
The Vietnam Service Medal (VSM) may be awarded to personnel assigned TDY
for 30 consecutive, or 60 nonconsecutive days, in support of the Vietnam
conflict in Vietnam, Thailand, Laos, and Cambodia during the period 4 July
1965 through 28 March 1973.

AIR FORCE EVALUATION:
AFPC/DPPPR recommends denial of the applicant’s request for the Vietnam
Service Medal (VSM) and states, in part, that although he has provided a
copy of an order assigning him TDY to Vietnam, he has not provided a copy
of his travel voucher showing the length of the TDY. Without such
evidence, they are unable to verify his eligibility for the VSM.

APPLICANT’S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the Air Force evaluation was forwarded to the applicant
on 26 March 2004 for review and response within 30 days. However, as of
this date, this office has received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. In this respect, we note the VSM may be
awarded to personnel assigned TDY for 30 consecutive, or 60 nonconsecutive
days, in support of the Vietnam conflict in Vietnam, Thailand, Laos, and
Cambodia during the period 4 July 1965 through 28 March 1973. The
applicant has provided orders assigning him TDY to the 377th Air Base Wing,
Tan Son Nhut AB, Republic of Vietnam, for a period of approximately 60
days, for manning assistance. However, he has not been able to obtain a
copy of the travel voucher showing the actual length of the TDY, since
travel vouchers from the Vietnam era are no longer maintained. In view of
this, and absent evidence that he did not perform the TDY specified in his
orders for at least 30 consecutive days, we believe the interest of justice
can best be served by resolving any doubt regarding this issue in his
behalf. Therefore, we recommend his records be corrected to the extent
indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT be corrected to show that on 29 July 1972, he was awarded the
Vietnam Service Medal (VSM).

Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to XXXXXXX, JR., XXXXXXX, be corrected to show that on 29 July
1972, he was awarded the Vietnam Service Medal (VSM).
