APPLICANT REQUESTS THAT:
Her date of rank (DOR) to first lieutenant be corrected.

APPLICANT CONTENDS THAT:
Upon joining the Air Force, it was agreed upon that she would enter
as a second lieutenant and be promoted to first lieutenant within
one year. This offer was made based on the shortages of nurses in
her field of expertise, critical care, and her nursing experience
level in trauma, neurology, pediatrics and open-heart nursing. She
feels that she was misled and her commission was under false
pretense (Exhibit A).

STATEMENT OF FACTS:
On 14 March 2000, applicant was appointed 2nd Lieutenant, Reserve
of the Air Force, Nurse Corps. She was voluntarily ordered to
extended active duty (EAD) on 20 March 2000. Upon entry on EAD,
she was given 9 months and 22 days constructive service credit for
professional experience and three days entry grade credit. Her
date of rank (DOR) as a 2nd Lieutenant was established as 25 May
99. She was promoted to the grade of First Lieutenant, with a DOR
of 25 May 01.

AIR FORCE EVALUATION:
HQ AFPC/DPAMF2 reviewed this application and recommended denial.
The applicant was awarded appropriate service credit in accordance
with AFI 36-2005, Appointment in Commissioned Grades and
Designation and Assignment in Professional Categories—Reserve of
the Air Force and United States Air Force. They further state that
although it could not be determined who made the agreement with the
applicant that she would be promoted within a year, no
documentation supports such an action.

HQ AFPC/DPPAO reviewed the application and recommended denial.
Upon entry to active duty, an AF Form 282, Date of Rank (DOR)
Computation, was accomplished and the personnel data system (PDS)
was updated awarding the applicant all constructive service credit.
Based on the governing directives, the applicant’s DOR was
computed correctly.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluations were forwarded to the applicant
on 7 Jun 02 for review and comment within 30 days. As of this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice of
the applicant's complete submission in judging the merits of the
case; however, we agree with the opinions and recommendations of
the Air Force offices of primary responsibility and adopt their
rationale as the basis for our conclusion that the applicant has
not been the victim of an error or injustice. Therefore, in the
absence of evidence to the contrary, we find no compelling basis to
recommend granting the relief sought in this application.

The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

In a letter dated 18 Jan 06 (Exhibit C), HQ AFPC/DPAMF2 requested the applicant explain why she felt she should have been awarded the grade of captain when she entered active duty. The time between her commissioning as a lLT in the Air Force Reserve on 2 Nov 78 and when she entered active duty on 10 Jan 79 is not active service nor creditable as active service for retirement. However, the Air Force would only grant half-time for work experience and, because the NCA and ASCP were the only certifying agencies accepted by the Air Force, would only credit her work experience from Aug 93 when she received her certification from the ASCP. Upon entering active duty, the applicant’s date of rank was established in accordance with AFI 36-2604, Service Dates and Dates of Rank, para 7.5.1. In this regard, the Air Force states that had the applicant entered active duty from civilian status some of her professional experience would have been used in computing her date of rank. The Board is of the opinion that the applicant’s date of rank was computed in accordance with existing regulations.
