MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force Board for Correction of Military Records and under the authority of Section 1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force relating to, be corrected to show that the closeout date of the Air Force Commendation Medal (AFCM) be changed from ~ Jun 98 to 16 Jun 97 and that the Recommendation for Decoration Printout (RDP) (DECOR-6), for the award of the AFCM was signed by the commander on 30 Nov 97.
It is further directed that he be provided supplemental consideration for promotion to the grade of technical sergeant for promotion cycle 98E6.
If AFPC discovers any adverse factors during or subsequent to supplemental consideration that are separate and apart, and unrelated to the issues involved in this application, that would have rendered the applicant ineligible for the promotion, such information will be documented and presented to the Board for a final determination on the individual's qualifications for the promotion.
If supplemental promotion consideration results in the selection for promotion to the higher grade, immediately after such promotion the records shall be corrected to show that he was promoted to the higher grade on the date of rank established by the supplemental promotion and that he is entitled to all pay, allowances, and benefits of such grade as of that date.

APPLICANT REQUESTS THAT:
The closeout date of his Air Force Commendation Medal (AFCM) be changed from August 1998 to December 1997 and he be reconsidered for promotion to technical sergeant for cycle 98E6.
APPLICANT CONTENDS THAT:
Processing problems delayed his decoration from being completed in a timely manner and this untimely delay resulted in his AFCM not being included into his records and subsequently negatively impacted his promotion opportunity.
In support of his application, he submits a personal statement and statements from his Commander, supervisors and co-workers (Exhibit A).
STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted from the applicant's military records, are contained in the letter prepared by the appropriate office of the Air Force. Accordingly, there is no need to recite these facts in this Record of Proceedings.
AIR FORCE EVALUATION:



closeout date of the decoration is 5 Jun 98, and the certificate was signed on 27 Aug 98, once the package was submitted into official channels, the decoration was approved within two-and-ahalf months. Therefore, the decoration was processed and awarded in a timely manner and DPPPR recommends denial of the applicant's request (Exhibit C).
The Chief Inquiries/AFBCMR Section, AFPC/DPPPWB reviewed the application and recommended denial. DPPPWB states that the decoration does not meet the criteria for promotion credit during the 98E6 cycle because the DEcOR-6, Recommendation for Decoration Printout was 29 Jul 98, after the selections were made on 20 May 98. In addition, the closeout date of the decoration was 5 Jun 98, well after the 31 Dec 97 promotion eligibility cutoff date
(PECD) for the 98E6 cycle.
After an extensive review of the circumstances of this case to include documentation the applicant has provided, there is no conclusive evidence the decoration was submitted before the date of selections for the 98E6 cycle. While we are acutely aware of the impact this recommendation has on the applicant's career; the fact is the decoration was not submitted until after the selections for this cycle were made. Therefore, we defer to the recommendation of AFPC/DPPPR recommendation and recommend denial of the applicant's request (Exhibit D).
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A complete copy of the Air Force evaluation was forwarded to the
applicant on for review and response. As of this date, no
response has been received by this office.
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or regulations.
2.
The application was timely filed.
3. Sufficient relevant evidence has been presented to demonstrate the existence of probable error or injustice. Having carefully reviewed this application, the efforts made by the applicant's commander and the letters from his chain of command in support of his appeal, we believe the decoration was not placed into the official channels due to administrative error. Moreover, the applicant's supervisor and commander admit the decoration was not acted on due to negligence. With respect to the closeout date of the award, it was noted that there are several assertions as to what the inclusive dates should be for the AFCM. The Board is of the opinion that the commander is the

authority for the recommendation, therefore the ending date for the award should be 16 Jun 97. Through no fault of the applicant, his record was incomplete at the time he was considered for promotion in the 98E6 cycle in that the AFCM in question was not in his records. We believe the applicant was improperly disadvantaged because of the absence of a document that should have been in the record for consideration by the promotion board in question. Accordingly, in order to resolve any potential promotion injustice to the applicant, the Board believes that any doubt in this matter should be resolved in his favor and that the record should be corrected in the following manner.
THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating to APPLICANT be corrected to show that the closeout date of the Air Force Commendation Medal (AFCM) be changed from 5 Jun 98 to 16 Jun 97 and that the Recommendation for Decoration Printout (RDP) (DECOR-6), for the award of the AFCM was signed by the commander on 30 Nov 97.
It is further recommended that he be provided supplemental consideration for promotion to the grade of technical sergeant for promotion cycle 98E6.
