Applicant requests that his records be corrected to reflect award 
of the Purple Heart.  Applicant's submission is at Exhibit A. 

The  appropriate Air  Force  office  evaluated  applicant's request 
and provided  an advisory opinion to  the  Board  recommending the 
application be  denied  (Exhibit C).  The  advisory  opinion  was 
forwarded to the applicant for review and response  (Exhibit D). 
As of this date, no respons'e has been received by this office. 

After  careful  consideration  of  applicant's  request  and  the 
available evidence  of  record, we  find  insufficient  evidence of 
error or injustice to warrant  corrective action.  The facts and 
opinions stated in the advisory opinion appear to be based on the 
evidence  of  record  and  have  not  been  rebutted  by  applicant. 
Absent  persuasive evidence applicant was denied rights to which 
entitled,  appropriate  regulations  were  not  followed,  or 
appropriate  standards  were  not  applied,  we  find  no  basis  to 
disturb the existing record. 

Accordingly, applicant's request is denied. 

The Board staff is directed to inform applicant of this decision. 
Applicant should also be informed that this decision is final and 
will only be  reconsidered upon the presentation of new relevant 
evidence  which  was  not  reasonably  available  at  the  time  the 
application was filed.

We have carellly reviewed the complete case file and records as requested by your 5 

February 1998 letter for consideration of entitlement to the Purple Heart (PH). Our 
comments are listed below. 

We recommend denial of applicant's most recent request (DD Form 149, dated 6 

October 1997) for award of the PH.  To be awarded the PH, a member must provide 
documentation to support he was wounded as a direct result of enemy action and must have 
received medical treatment by medical personnel,  Applicant's records, statement, medical 
documents recorded do not support his claim.  Member did not provide any eye witnesses to 
substantiate his claim. 

On 8 December 1997, we requested member provide additional documentation 

within 60 days.  We have not received any additional documentation as of this date. 

With the above information, we must recommend denial of his request.  If we can be
