THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests his Service Computation for Separation be corrected in item 22 (Total Service for Basic Pay Purposes) to show 37 years, 7 months, and 7 days vice 36 years, 7 months, and 7 days.

2.  The applicant states he received a 2-year educational delay prior to his entry on active duty; however, his service computation accounts for only the first year of his 2-year delay.

3.  The applicant provides:

* DA Form 591 (Application for Initial (Educational) Delay from Entry on Active Duty/ACDUTRA and Reserve Participation Agreement), dated 14 June 1974
* DA Form 591a (Supplemental Active Duty/ACDUTRA and Reserve Participation Agreement for ROTC Participants Applying for Initial (Educational) Delay from Entry on Active Duty), dated 6 June 1974
* Knox College (IL) undergraduate transcripts, dated 2 June 1974
* Tulane University (LA) graduate transcripts, dated 14 August 1976
* Medical examinations for 1974 and 1975

CONSIDERATION OF EVIDENCE:

1.  The applicant is a Regular Army lieutenant general.

2.  The applicant was a Reserve Officers’ Training Corps (ROTC) cadet.  Upon graduation from Knox College, he was offered and accepted appointment as a Reserve commissioned officer on 26 July 1974.

3.  On 6 June 1974, the applicant submitted a DA Form 591 requesting a 2-year delay from entry on active duty in order to obtain a graduate degree.  On 14 June 1974, his request was approved for a 1-year delay from July 1974 to July 1975.  It was stipulated he must apply for renewal of the second year of his delay within 120 days of the July 1975 termination date for year one.

4.  There is no record showing the applicant applied for renewal of his delay to cover his second year of graduate school from July 1975 to July 1976.

5.  The record shows the applicant underwent a physical examination in April 1975 and was found qualified for "Retention and EAD [entry on active duty]."

6.  The applicant completed his graduate work in the spring of 1976 and entered active duty on 24 May 1976.  He has served continuously and is scheduled to be retired on 31 December 2011 and placed on the retired list on 1 January 2012.

DISCUSSION AND CONCLUSIONS:

1.  The applicant requires an approved DA Form 591 granting him an educational delay from entry on active duty for the period July 1975 to July 1976.

2.  Through oversight or administrative error, a DA Form 591 cannot be located which approved the applicant's second year delay from entry on active duty.  Clearly, the applicant continued his graduate education and completed same before entering on active duty on 24 May 1976.

3.  It would be appropriate to show the applicant requested and received approval to delay entry on active duty for a second year from July 1975 to July 1976.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by showing:

* the applicant made timely application for renewal of his educational delay by submitting a DA Form 591
* his DA Form 591 was approved to extend his educational delay for the period July 1975 to July 1976

2.  The Board further recommends that the Chief, Officer Retirement and Separations, U.S. Army Human Resources Command, recalculate the applicant's total service for basic pay purposes and prepare another Service Computation for Separation worksheet to account for this additional educational delay.

3.  The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief.  As a result, the Board recommends denial of so much of the application that pertains to correcting his Service Computation for Separation in item 22 to show 37 years, 7 months, and 7 days at this time.
