Facts and Circumstances: The evidence of record shows that on 8 July 2008, the unit commander notified the applicant of initiation of separation action under the provisions of Chapter 14, paragraph 14-12b, AR 635-200, by reason of pattern of misconduct. On 13 March 2008, the applicant was apprehended in Junction City, Kansas for allegations that he took part in a shooting. He was charged with aggravated assault and was facing other charges from Geary County. On 6 May 2008, he was apprehended in Milwaukee, Wisconsin for being involved in a drive by shooting, where his vehicle received four bullet holes in the driver side of the car, at the time of his arrest he was wearing body armor and was in possession of a high point, 9mm weapon. The passenger in his car admitted to police that he was a gang member in the Orchestra Albany, a member of Folk Nation. On 20 June 2008, he was apprehended on Fort Riley, Kansas for underage drinking, impersonating an NCO, drunk and disorderly, assault, unlawful entry and resisting apprehension. He had allegedly entered building 8008 on Fort Riley and went into the room of a female Soldier and impersonated an NCO. When confronted by the CQ NCO, he pushed the NCO and ran. He was confined in Geary County jail on 23 June 2008 for breaking the provisions of his bond. The unit commander recommended a discharge from the Army with a characterization of general, under honorable conditions discharge. He was advised of his rights. On 15 July 2008, the applicant consulted with legal counsel, was advised of the impact of the discharge action, and submitted a statement in his own behalf. The unit commander subsequently recommended separation from the Army and waiver of further rehabilitative efforts. The intermediate commander reviewed the proposed discharge action and recommended approval of the separation action with a general, under honorable conditions discharge. The separation authority waived further rehabilitative efforts and directed the applicant’s discharge with a characterization of service of general, under honorable conditions. The record contains a Civilian Police Report dated 12 March 2008 and a Military Police Report dated 21 June 2008. b. Legal Basis for Separation: Army Regulation 635-200 sets forth the basic authority for the separation of enlisted personnel. Chapter 14 of this regulation establishes policy and prescribes procedures for separating members for misconduct. Specific categories include minor disciplinary infractions, a pattern of misconduct, and commission of a serious offense, to include abuse of illegal drugs, convictions by civil authorities and desertion or absence without leave. Action will be taken to separate a member for misconduct when it is clearly established that rehabilitation is impractical or unlikely to succeed. Army policy states that an under other than honorable conditions discharge is normally considered appropriate, however, a general, under honorable conditions or an honorable discharge may be granted. c. Response to Issues, Recommendation and Rationale: After a careful review of all the applicant’s military records, and the issue and documents submitted with the application, the analyst found no mitigating factors which would merit an upgrade of the applicant's discharge. The analyst determined that the applicant’s discharge was appropriate because the quality of his service was not consistent with the Army's standards for acceptable personal conduct and performance of duty by military personnel. By his misconduct, the applicant diminished the quality of his service below that meriting a fully honorable discharge. The applicant provided no independent corroborating evidence demonstrating that either the command's action was erroneous or that the applicant’s service mitigated the misconduct or poor duty performance. The applicant contends that the narrative reason for his discharge and reentry code should be changed. However, the applicant was separated under the provisions of Chapter 14, paragraph 14-12b, AR 635-200 with a general, under honorable conditions discharge. The narrative reason specified by Army Regulations for a discharge under this paragraph is "Pattern of Misconduct,” and the separation code is "JKA," with a reentry code of “3.” Army Regulation 635-5, Separation Documents, governs preparation of the DD Form 214 and dictates that entry of the narrative reason for separation, entered in block 28, the separation code, entered in block 26, and the reentry code entered in block 27 of the form, will be entered exactly as listed in tables 2-2 or 2-3 of AR 635-5-1, Separation Program Designator (SPD) Codes. The regulation further stipulates that no deviation is authorized. There is no provision for any other reason to be entered under this regulation. Further, the analyst noted the applicant's issue about trying to move on with his life and get the GI Bill benefits to go to school; however, eligibility for veteran's benefits to include educational benefits under the Montgomery GI Bill does not fall within the purview of the Army Discharge Review Board. Accordingly, the applicant should contact a local office of the Department of Veterans Affairs for further assistance. Additionally, the Board does not grant relief solely for the purpose of gaining employment or enhancing employment opportunities. Finally, the record does not support the issue that the applicant suffers from Post Traumatic Stress Disorder and no evidence to support it has been submitted by the applicant, that the discharge was the result of any medical condition. Therefore, the analyst determined the reason for discharge and the characterization of service were both proper and equitable and recommends to the Board to deny relief. VII.
