Facts and Circumstances: Evidence of record shows that on 7 November 2005, the applicant voluntarily tendered his unqualified resignation from the service under the provisions of Chapter 3, paragraph 3-5; AR 600-8-24, by reason of miscellaneous general reasons (wants to pursue his career in the civilian sector). The record also shows that the applicant’s Senior chain of command recommended approval of his request for resignation with a characterization of service of honorable. On 8 February 2006, CDR-AHRC Alexandria, VA//AHRC-OPD-A//CDR 1st PERSCOM Schwetzingen, Germany approved the applicant's unqualified resignation from the service with issuance of a general under honorable conditions discharge. The record contains a properly constituted DD Form 214 (Certificate of Release or Discharge from Active Duty), which was authenticated by the applicant’s signature. His DD Form 214 indicates that he was discharged under the provisions of Chapter 3, paragraph 3-5, AR 600-8-24 by reason of miscellaneous/general reasons with a characterization of service of general, under honorable conditions and a separation code (SPD) of "FND." b. Response to Issues, Recommendation and Rationale: After a careful review of all the applicant’s military records, and the independent evidence he submitted, the analyst found several mitigating factors to recommend an upgrade of the characterization of service to fully honorable. This recommendation was made after full consideration of his faithful and honorable service. The evidence in this case supports a conclusion that the applicant’s characterization of service was too harsh and as a result it is inequitable. The analyst found that the overall length and quality of the applicant's service, to include his combat service, the senior commander's recommendation for an honorable characterization of service and that the applicant's record does not indicate that he was subject to any disciplinary actiion under the UCMJ.
