Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his WD AGO Form 100 (Separation Qualification Record) to show his social security number (SSN) as 0XX-XX-XXXX instead of 2XX-XX-XXXX. 2. The applicant states the SSN shown on his WD AGO Form 100 is incorrect. 3. The applicant provides his WD AGO Form 100, Honorable Discharge Certificate, and a copy of his social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's complete military records are not available for review. A fire destroyed approximately 18 million service members' records at the National Personnel Records Center in 1973. It is believed that his records were lost or destroyed in that fire. This case is being considered based on the documents provided by him and a DD Form 214 (Certificate of Release or Discharge from Active Duty) documenting his service from 3 April 1943 to 15 May 1944. 3. The applicant was issued a DD Form 214 under the provisions of Public Law 95-202 (U.S. Code, Title 38, Note 106) to document his active duty service in the U.S. Army Transport Service (Merchant Marine) from 3 April 1943 to 15 May 1944. This document shows his SSN as 0XX-XX-XXXX. 4. His WD AGO Form 100 and Honorable Discharge Certificate show he entered active duty on 20 September 1945 and that he was honorably discharged on 1 February 1947. The WD AGO Form 100 shows his SSN as 2XX-XX-XXXX. 5. The WD AGO Form 100 and the Honorable Discharge Certificate are the only records available documenting his service from 20 September 1945 to 1 February 1947. 6. He provided a copy of his social security card which shows his SSN as 0XX-XX-XXXX. 7. The purpose of the WD AGO Form 100 was to assist World War II veterans in post-service employment, education, or any other endeavor by the service member. Information about civilian education and work experience is based on the Soldier's military personnel service records and supplement by the Soldier's own statements. This document is no longer available in the Army's inventory. DISCUSSION AND CONCLUSIONS: 1. The applicant was issued a DD Form 214 to document his active duty service in the U.S. Army Transport Service (Merchant Marine) from 3 April 1943 to 15 May 1944. This document shows his SSN as 0XX-XX-XXXX, as shown on his social security card. It appears that during the preparation of his WD AGO Form 100 an administrative error occurred that resulted in his SSN being incorrectly listed. 2. In view of the foregoing, his WD AGO Form 100 should be amended to show his SSN as it is shown on his social security card.
