THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests award of the second 10-year device for wear on his already-awarded Armed Forces Reserve Medal (AFRM). 2. The applicant states: a. He was told his unit could not issue the memorandum awarding the second 10-year device due to his period of service in the Army National Guard (ARNG). b. He feels he has the qualifying service to justify the second 10-year device. c. He has 10 qualifying years of service from December 1987 to May 1999. 3. The applicant provides: * U.S. Army Human Resources Command statement of retirement points * email correspondence CONSIDERATION OF EVIDENCE: 1. Having prior active service in the Regular Army, the applicant enlisted in the ARNG on 17 December 1987. On 16 December 1990, he was honorably discharged from the ARNG and assigned to the U.S. Army Reserve (USAR) Control Group (Reinforcement). He was released from the USAR Control Group (Reinforcement) and assigned to the ARNG effective 14 May 1992. On an unknown dated, he was discharged from the ARNG. 2. Following a break in service, the applicant enlisted in the ARNG on 26 May 2000. 3. He was ordered to active duty on 3 May 2003 in support of Operation Noble Eagle. He was released from active duty on 4 November 2003. His DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 4 November 2003 shows, among other awards, the AFRM with "M" Device. 4. He was discharged from the ARNG on 7 April 2004 and assigned to the USAR Control Group (Reinforcement). 5. He was ordered to active duty on 15 May 2005 in support of Operation Iraqi Freedom. He was released from active duty on 28 July 2006. His DD Form 214 for the period ending 28 July 2006 shows, among other awards, the AFRM with "M" Device (2nd Award) (interpreted to mean Numeral 2). 6. He was promoted to sergeant first class on 28 February 2007. He was ordered to active duty in an Active Guard Reserve (AGR) status on 21 July 2008. 7. His statement of retirement points shows: a. He completed a minimum of 10 qualifying years of service (earned at least 50 points per retirement year) in a Reserve Component from 17 December 1987 to 10 October 1999. b. He completed a minimum of 10 qualifying years of service in a Reserve Component from 26 May 2000 to 25 May 2010. 8. Army Regulation 600-8-22 (Military Awards) states the AFRM is awarded for honorable and satisfactory service as a member of one or more of the Reserve Components for a period of 10 years. a. The conditions for award of the AFRM require that a minimum of 50 retirement points be earned for each of the 10 qualifying years and that the qualifying service be completed within 12 consecutive years. Service in a Regular Component of the Armed Forces; tenure in an elected State office; tenure as a member of a legislative body of the United States or a State; and service as a judge of a court of record of the United States, a State or Territory, or the District of Columbia is excluded from credit toward this award but does not constitute a break in service. b. The 10-year device (hourglass with Roman numeral "X") is authorized for wear on the AFRM to denote each 10-year period of Reserve Component service. The first 10-year period is denoted by a bronze hourglass, the second 10-year period by a silver hourglass, and the third by a gold hourglass. Forty years of Reserve Component service is recognized by a gold hourglass followed by a bronze hourglass. c. The "M" device is authorized for wear on the AFRM by members of the Reserve Components who are called or who volunteer and serve on active duty on or after 1 August 1990 in support of specific U.S. military operations or contingencies designed by the Secretary of Defense as defined in Title 10, U.S. Code, section 101(A)(13). Active Guard Reserve members who receive orders changing their current duty status (legal authority under which they perform duty), their duty location, or assignment to support a contingency operation are eligible for the award of the "M" device. 9. The Department of Defense Manual specifies contingencies designated by the Secretary of Defense as defined in Title 10, U.S. Code, section 101(A)(13), which includes the Global War on Terrorism (comprised of Operation Noble Eagle, Operation Enduring Freedom, and Operation Iraqi Freedom). DISCUSSION AND CONCLUSIONS: 1. The applicant's statement of retirement points shows he completed two periods of 10 qualifying years (earned a minimum of 50 retirement points) within 12 consecutive years in a Reserve Component. The first qualifying period was 17 December 1987 to 10 October 1999 and the second qualifying period was 26 May 2000 to 25 May 2010. Therefore, there is sufficient evidence on which to base award of the second 10-year Device for his already-awarded AFRM. 2. It is noted that although his DD Form 214 for the period ending 28 July 2006 shows award of the AFRM with "M" Device (2nd Award) (interpreted to mean Numeral 2), his records show his periods of active duty service in support of Operation Noble Eagle and Operation Iraqi Freedom were performed under a single designated contingency as defined in Title 10, U.S. Code, section 101(A)(13).
