THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 31 July 2014 to show his rank/grade as private first class (PFC)/E-3. 2. The applicant states he believes a typographical error has occurred. 3. The applicant provides a copy of his DD Form 214 and DA Form 4187 (Personnel Action). CONSIDERATION OF EVIDENCE: 1. The applicant's DD Form 4 (Enlistment/Reenlistment Document - Armed Forces of the United States) shows he enlisted in the U.S. Army Reserve (USAR) on 19 September 2013, in the rank/grade of private/E-1. 2. His record contains: a. Transcripts from KD College, dated 13 June 2013, that show he was awarded an Associate of Applied Arts degree on 17 May 2013. b. Orders 036-269, issued by U.S. Army Installation Management, Headquarters, U.S. Army Garrison, Fort Jackson, SC, dated 5 February 2014, which attach him to Headquarters and Headquarters Company, 15th Signal Battalion, Fort Gordon, GA, effective 14 March 2014 for training in military occupational specialty 94F (Computer Detection Systems Repairer). On the standard name line of these orders his rank is listed as "PFC." 3. On 31 July 2014, the applicant was released from active duty training. The DD Form 214 he was issued lists his rank/grade as private (PV2)/E-2. 4. The applicant provides a DA Form 4187, issued by a representative of the Commander, 223rd Maintenance Company, dated 27 December 2013, that shows the applicant was advanced in rank/grade to PFC/E-3, effective 27 December 2013, in accordance with Army Regulation 601-210 (Active and Reserve Components Enlistment Program), chapter 2-18a(7), for completion of 48 or more semester hours of college. 5. Army Regulation 601-210, governs eligibility criteria, policies, and procedures for enlistment and processing of persons into the Regular Army, the USAR, and Army National Guard. Chapter 2-18a(7) states applicants with an associate degree will be enlisted at the rank/grade of PFC/E-3 without regard to the number of semester or quarter hours completed. DISCUSSION AND CONCLUSIONS: 1. The evidence of record shows the applicant's Associate of Applied Arts degree was conferred on 17 May 2013. He enlisted in the USAR on 19 September 2013. 2. Further evidence provided by the applicant or contained in his military records appears to corroborate the applicant's claim. As cited in the above regulation, an applicant who successfully completes an associate degree may enlist in pay grade E-3. Therefore, in the interest of equity, it would be appropriate to correct his records to show he enlisted in the USAR in the rank/grade of PFC/E-3 and to pay him any retroactive pay and entitlements to which he is entitled as a result of this correction.
