THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests correction of the social security number (SSN) shown on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). 

2.  He states his SSN on his DD Form 214 is incorrect.  The correct SSN should be XXX-XX-0XXX vice XXX-XX-6XXX, now of record.

3.  He provides his:

* social security card
* Medicare card
* DD Form 214

CONSIDERATION OF EVIDENCE:

1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice.  This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so.  While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file.  In all other respects, there are insufficient bases to waive the statute of limitations for timely filing.

2.  On 27 November 1963, the applicant was inducted into the Army of the United States.  

3.  The applicant's DA Form 20 (Enlisted Qualification Record) does not list the applicant's SSN but lists only his service number.

4.  The applicant received Special Order Number 322, dated 18 November 1965, that relieved him from active duty and transferred him to the U.S. Army Reserve (USAR) with a service number vice an SSN.

5.  On 23 November 1965, the applicant was honorably released from active duty.  Item 2 (Service Number) of the DD Form 214 is used vice the SSN.  However, item 32 (Remarks) lists his SSN as XXX-XX-6XXX vice XXX-XX-0XXX.

6.  On 18 January 1969, while still attached to the USAR, he requested a correction to his DD Form 214 to show his SSN was XXX-XX-0XXX vice 
XXX-XX-6XXX.

7.  The applicant provides his social security and Medicare cards that shows his SSN as XXX-XX-0XXX.  

DISCUSSION AND CONCLUSIONS:

The U.S Army used service numbers vice SSN's during his time of service.  However, on the applicant's DD Form 214, it lists his incorrect SSN.  Prior to his discharge from the USAR in 1969, the applicant requested a correction to his DD Form 214 to list his correct SSN.  It appears an administrative error resulted in the incorrect SSN being listed on his DD Form 214.  It would be appropriate to correct his DD Form 214, item 32 to show the SSN listed on his social security card.

BOARD DETERMINATION/RECOMMENDATION:

The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by replacing the SSN listed on the applicant's DD Form 214, item 32 with the SSN shown on his social security card.
