Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Forms 214 (Certificate of Release or Discharge from Active Duty) for the periods ending 8 September 2002 and 30 September 2009 to show award of the Global War on Terrorism Service Medal (GWOTSM) and a fourth award of the Army Good Conduct Medal (AGCM). 2. The applicant states: a. He would like to receive the fourth award of the AGCM. He has 12 years of active service. He finished his enlistment before the fourth award of the AGCM was recommended by his platoon sergeant. b. He served from 12 September 1990 to 8 September 2002. He was not awarded the GWOTSM. All Soldiers serving on active duty from 11 September 2001 until 31 March 2004 were given this award. His DD Form 214 for the period ending 8 September 2002 shows he was serving on active duty at the time. 3. The applicant provides: * DD Forms 214 for the periods ending 8 September 2002 and 30 September 2009 * Army National Guard (ARNG) Retirement Points History Statement * Internet excepts pertaining to the GWOTSM CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 12 September 1990 and trained as a motor transport operator. He served in Southwest Asia from 29 January 1991 to 6 June 1991. He remained on active duty through continuous reenlistments. On 8 September 2002, he was honorably discharged for completion of required active service. 2. His DD Form 214 for the period ending 8 September 2002 shows the AGCM (3rd Award) as an authorized award. This DD Form 214 does not show the GWOTSM as an authorized award. 3. There are no orders for a fourth award of the AGCM in the available records. 4. He enlisted in the ARNG on 3 April 2008. He was ordered to active duty on 1 October 2008 and he was released from active duty on 30 September 2009. 5. His DD Form 214 for the period ending 30 September 2009 shows the AGCM (3rd Award) as an authorized award. This DD Form 214 does not show the GWOTSM as an authorized award. 6. He was discharged from the ARNG and assigned to the Retired Reserve on 10 August 2014. 7. Army Regulation 600-8-22 (Military Awards) states the GWOTSM is authorized for award to members of the Armed Forces of the United States who participated in Global War on Terrorism operations outside of the areas of eligibility designated for award of the Global War on Terrorism Expeditionary Medal, Afghanistan Campaign Medal, or Iraq Campaign Medal. All Soldiers on active duty, including Reserve Component Soldiers mobilized or National Guard Soldiers activated, on or after 11 September 2001 to a date to be determined, having served 30 consecutive or 60 nonconsecutive days are authorized award of the GWOTSM. 8. Army Regulation 600-8-22 states the AGCM is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity. This period is 3 years (consecutive) except in those cases when the period for the first award ends with the termination of a period of active Federal military service. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified. DISCUSSION AND CONCLUSIONS: 1. The applicant served a period of qualifying service for award of the GWOTSM. Therefore, his DD Forms 214 for the periods ending 8 September 2002 and 30 September 2009 should be corrected to show this medal. 2. Although he contends he has 12 years of active service, the evidence of record shows he completed 11 years, 11 months, and 27 days of creditable active service. His DD Forms 214 for the periods ending 8 September 2002 and 30 September 2009 show the AGCM (3rd Award). There are no orders for a fourth award of the AGCM in the available records. Since the governing regulation states a period of qualifying service for award of the AGCM is 3 consecutive years and he did not complete 12 consecutive years of qualifying service, it appears he is not eligible for a fourth award of the AGCM. The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding award of the GWOTSM to his DD Forms 214 for the periods ending 8 September 2002 and 30 September 2009. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief.
